X:G~2,~PLA.b. 3 -A fA,?c- J -S"t.J:eit...I-~pffite ,-Ce-<-t:-...h Btto'mel CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.~ AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PUBLIC ALLEY AND VESTING OWNERSHIP THEREOF IN THE ABUTTING PROPERTY OWNERS WHEREAS,on January 26,1984,Mr.and Mrs.LARRY HUSBY, DIANA P.BARSTAD and PHYLLIS SPRAGUE submitted a petition to the City of Marysville requesting the vacation of a 16-foot-wide, unimproved public alley,the legal description of which is attached hereto and incorporated herein by this reference;and WHEREAS,on March 26,1984,a public hearing was held on said petition,and the City Council entered the following findings: 1.The alley has never been opened and constitutes abandoned pUblic right-of-way as defined in RCW 36.87.090. 2.The vacation of the alley will not adversely affect the street pattern or circulation of the immediate area or the community as a whole. 3.Public need will not be adversely affected. 4.The alley is not contemplated or needed for future public use. 5.No abutting owner will become land1ocked,nor will access for any abutting property be sub- stantially impaired. Based upon the foregoing findings,the City Council of "the City of Marysville,Washington DO ORDAIN as follows: The above-described alley is hereby vacated,and the right of the public to use or claim any right,title or interest in said alley is hereby terminated.Ownership of the alley shall hereby revert to the abutting property owners,with one-half of the alley being vested in the owners on each side of the same.
