AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING CERTAIN PROPERTY WITHIN THE CITY LIMITS AND AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772. WHEREAS,JOHN W. SIMS is the owner of certain real property located at 1046 Cedar Avenue,Marysville,Washington, the same being legally described as follows: The North one-half of Lot 5,Block 3,Edward Steele's Second Addition to Marysville,as per plat recorded in Volume 5 of Plats,page 12, records of Snohomish County,situated in the County of Snohomish,State of Washington; WHEREAS,said owner has filed a petition with the City Clerk seeking a rezone of said property from the Multiple-Family, Medium-Density classification to the Community-Business classi- fication;and WHEREAS,the City Planning Commission held a public hearing on said rezone on April 24,1984,and sUbmitted formal Findings of Fact and a recommendation in favor of granting said rezone;and WHEREAS,the City Council held a public hearing on said rezone on June 11,1984,and determined that the recommen- dation of the Planning Commission was consistent with the public interest;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF t~RYSVILLE,WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1.The Findings of Fact of the Planning Com- mission with respect to the rezone application of JOHN W. SIMS are hereby adopted by reference,and the above-described property is hereby rezoned from the Medium-Density,Multiple-Family Resi- dential classification to the Community-Business classification subject to the following conditions: (a)A six-foot cyclone fence shall be constructed along the north and south property lines; Ordinance - 1 'Ii .........'.'~.."-_~.r' (b)At such time as the subject property is subdivided, or is developed for commercial uses which are more intense than mere storage of personal property in a single storage building,the following additional improvements will be made: (i)The above-referenced fencing shall be made sight-obscuring; (ii)The house existing on the front of the prop- erty shall be removed so as to provide legal access to the commercial storage building in the rear of the property. Section 2.The Official Zoning Map of the City of Harys- ville,Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772,are hereby amended to reflect the reclassification of the above-described property to Community Business.
