ORDINANCE NO.13 ~9
AN ORDINANCE OF THE CITY OF r~RYSVILLE MERGING
THE PARK COMHISSION WITH THE GOLF BOARD,
ESTABLISHING A PARKS AND RECREATION BOARD,
DEFINING THE DUTIES OF THE PARKS AND RECREATION
SUPERINTENDENT,GOLF COURSE MANAGER AND GOLF
PROFESSIONAL,AND REPEALING CHAPTERS 2.20 AND
2.76 OF THE ~mRYSVILLE MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF ~mRYSVILLE,WASHINGTON,
DO ORDAIN AS FOLLOWS:
Chapter 2.20 of the ~larysville ~1unicipal Code ("Park
Commission")and Chapter 2.76 of the Marysville Municipal Code
("Municipal Golf Course")are hereby REPEALED for the reason
that the same are superseded by the new chapter enacted below.
A new chapter in Title 2 of the Marysville Municipal
Code entitled "Parks and Recreation"is hereby enacted to pro-
vide as follows:
Section 1.Parks and Recreation Department.The
Parks and Recreation Department of the City of Marysville shall
have executive and administrative responsibility for the follow-
ing functions:
(a)Management,operation,maintenance and improve-
ment of all public parks,and facilities located
thereon,public grounds,and landscaping on
pUblic right-of-way.
(b)Management and operation of public recreational
facilities and programs,and maintenance and
improvement of such facilities.
(c)Management and operation of Cedarcrest.Municipal
Golf Course,and maintenance and improvement of
all property and facilities thereon with the
exception of Cedarcrest Restaurant.

Section 2.Parks and Recreation Superintendent.The
Parks and Recreation Superintendent,as an employee of the City,
is responsible,through the City Administrator,to the Mayor and
City Council.The Superintendent,with the advice and assistance
of the Parks and Recreation Board and.the Golf Course Manager,
shall be responsible for the operation of all functions of the
Parks and Recreation Department,and the supervision of all employ-
ees thereof.
Section 3.Parks and Recreation Board --Established.
There is established a Parks and Recreation Board consisting of
five (5)members who are residents of the City.Board members
shall be appointed by the Mayor,subject to confirmation by the
City Council,and shall serve a term of three (3)years and until
their successors are duly appointed.The terms of office for the
first five members shall be staggered.The Mayor shall have the
right to remove any Board member from office whenever it is deemed
to be in the public interest.
Section 4.Board Organization.The Parks and Recrea-
tion Board shall annually choose one of its members to serve as
Chairperson for the term of one year.Each of the members shall
have one vote on all business coming before the Board.Three (3)
members shall constitute a quorum for the transaction of business.
Three (3)affirmative votes shall be necessary for the adoption or
approval of any measure.The Board shall hold regular public meet-
ings at least once a month,and the schedule of the time and place
thereof shall be kept in the office of the City Clerk.Board mem-
bers shall serve without compensation,but shall be entitled to
reimbursement for reasonable expenses when authorized by the Mayor
to attend any local,state,regional or national meetings on behalf
of the City.
Section 5.Board Powers and Duties.The Board shall act
in an advisory capacity on all matters within the jurisdiction of
the Parks and Recreation Department.No action shall be taken by
the City on any of the following matters without first being referred
to the Board for a recommendation:
(a)Long-range planning for parks,recreation and golf
course properties,facilities and programs;
(b)Capital improvements to parks,recreation and golf
course properties and facilities;
(c)Acquisition or disposal of parks,recreation or golf
course real property or facilities;
(d)Employement decisions relating to the Golf Course
Manager and the Golf Professional;
(e)Adoption of operating rules and regulations relat-
ing to parks,recreation or golf course properties
and facilities;

(f)Interlocal cooperation with parks and recreation
programs of other jurisdictions.
Section 6.Greens Fees.The Barks and Recreation Board
is delegated the power and authority to set the greens fees to be
charged to the public for the use of Cedarcrest Municipal Golf
Course.Notice of any proposed change in the greens fees shall be
given,in writing,to the Mayor and City Council not less than
thirty (30)days prior to the same being adopted.A current sched-
ule of duly adopted greens fees shall be open for public inspection
in the records of the City Clerk and on the premises of the golf
course.
Section 7.Golf Course Manager.The Golf Course Manager,
as an employee of the City,shall be responsible,through the City
Administrator,to the l1ayor and City Council.The Hanager shall
have the following duties and responsibilities:
(a)To act in an advisory capacity to the Parks and
Recreation Board and Superintendent on matters
relating to the management,operation,maintenance,
improvement and design of the golf course;
(b)To be responsible for the day-to-day operation of
the golf course as a business concern;
(c)To publicly promote the golf course and to encour-
age and solicit use of the same;
(d)To collect and make daily deposits with the City
Treasurer of all greens fees and other golf course
revenues,and to post a fidelity bond in an amount
to be established by the City Council;
(e)To enforce and implement all golf course rules and
regulations;
(f)To coordinate the operation of the golf course with
the activities of the Golf Professional;
(g)To make quarterly reports to the Parks and Recrea-
tion Board,and annual reports to the City Council,
regarding the golf course operation.
Section 8.Golf Professional.A Golf Professional shall
be hired by the City as an independent contractor,and the employ-
ment relationship shall be documented by a written contract executed
by the Mayor and renewable annually.The duties and responsiblities
of the Golf Professional shall include the following:

(a)To lease from the City the Pro Shop/Clubhouse
facilities at the golf course,and to strictly
comply with the terms and conditions of said
lease agreement;
(b)To operate,manage and maintain the Pro Shop
and Clubhouse facilities at his own cost and
expense;
(c)To provide golf lessons and other instruction;
(d)To hire,at his own risk and expense,sufficient
personnel to efficiently perform all functions
provided herein on a continuous basis at all
hours during which the golf course is open to
the pUblic.Provided,that the Mayor may require
the discharge of any employee hired by the Golf
Professional if the activities of such employee
are contrary to the pUblic interest;
(e)To act as the official starter for all golf games,
and to otherwise assist and coordinate with the
Golf Course Manager in the operation of the golf
course:
(f)To pay,before delinquency,all taxes,levies,
assessments and license fees for which the Golf
Professional is responsible as an independent
contractor;
(g)To make quarterly reports to the Parks and Recrea-
tion Board and annual reports to the City Council
regarding operations of the golf course.
PASSED by the City Council and APPROVED by the Hayor
