AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A
PUBLIC ALLEY AND VESTING OWNERSHIP THEREOF HJ THE
ABUTTING PROPERTY OWNERS
WHEREAS,on April 16,1984,CORNELIUS HORDYK,and four-
teen other property owners,submitted a petition to the City of
Marysville requesting the vacation of a l6-foot-wide,unimproved
pUblic alley being legally described as follows:
That certain alleyway running in an
east-west direction between 49th
Avenue N.E.and 47th Avenue N.E.and
bisecting blocks 5 and 4,Aubury~s
First Addition to Marysville according
to the plat thereof recorded in Volume
2 of Plats,page 77,Records of
Snohomish County AuditQr:and
WHEREAS,on June 11,1984,a public hearing was held on
said petition,and the City Council entered the following findings:
1.The subject alley has never been opened and consti-
tutes abandoned public right-of-way as defined in RCW 36.87.090.
2.The vacation of the alley will not adversely affect
the street pattern or circulation of the immediate area or the com-
munity as a whole.
3.The public need will not be adversely affected.
4.The alley is not contemplated or needed for future
public use.
5.No abutting owner will become landlocked,nor will
access for any abutting property be substantially impaired.
Based upon the foregoing findings,the City Council of
the City of Marysville,Washington,do ordain as follows:
The above-described alley is hereby vacated,and the right
of the pUblic to use or claim any right,title or interest in said

alley is hereby terminated.Ownership of the alley shall hereby
revert to the abutting property owners,with one-half of the alley
being vested in the owners on each side of the same.

ferred to,published in the English language continually as a
weekly newspaper in Marysville,Snohomish County,Wash-
ington,and it is now and during all of said time was printed
in an office maintained at the aforesaid place of publication
of said newspaper.That the annexed is a true copy of a

published in regular issues (and not in supplement form)of
