HomeMy WebLinkAboutO-1383 - Rezone (Special)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.t3g3, AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING CERTAIN PROPERTY WITHIN THE CITY LIMITS AND AMENDING THE OFFICIAL ZONING ~ffiP PREVIOUSLY ADOPTED IN ORDINANCE NUMBER 772 WHEREAS,HARVEY JUBIE and FRANK GADWA are the owners of certain real property located at 1234 Cedar Avenue,Marysville, Washington,the same being legally described in Exhibit "A" attached hereto and incorporated herein by this reference;and WHEREAS,said owners have filed a petition with the City Clerk seeking a rezone of said property from the single- family residential classification to the medium-density,multiple- family residential classification;and WHEREAS,the City Planning Commission held a public hearing on said rezone on July 24,1984,and submitted formal Findings of Fact and a recommendation in favor of granting said rezone;and WHEREAS,on August 13,1984,the City Council reviewed said Findings of Fact and reaffirmed the same,finding that the rezone was in the public interest;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1.The Findings of Fact of the Planning Commis- sion with respect to the rezone application of HARVEY JUBJE and FRANK GADWA are hereby adopted by reference,and the above-described property is hereby rezoned from the single-family residential classi- fication to the medium-density,multiple-family residential classi- fication,subject to the following conditions: (a)The subject property may only be developed in accordance with the site plan filed with the City on July 24,1984;any material deviations from said site plan shall require reconsider- ation of the rezone by the Planning Commission and City Council. Ordinance - 1 ........ (b)Prior to occupancy of any dwelling unit on the subject property,a site-obscuring fence shall be constructed for the full length of the north, south and east property lines. (b)The conditions of this rezone shall be binding upon the owners,their heirs,successors and assigns,and any violation of the same shall be cause for denial of building and development permits and revocation of the rezone granted herein. Section 2.The Official Zoning Map of the City of Marys- ville,washington,as adopted in 1972,and Section 5.02 of Ordinance No.772,are hereby amended to reflect the reclassification of the above-described property to the medium-density,multiple-family residential classification.
