HomeMy WebLinkAboutO-1388 - Amends Sec. 10.20.045, dogs and cats, and Sec. 19.08.260 and 19.08.261, zoning (Repealed by 2131)~I ( i/,~..2,.~k ~b, s ;oft UU:,.:· z-PtJlice- CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO./329' AN ORDINANCE OF THE CITY OF MARYSVILLE EXEMPTING VETERINARIAN CLINICS,PET SHOPS AND GROOMING PARLORS FROM THE REQUIREMENT OF OBTAINING A KENNEL PERMIT,AND AMENDING SECTIONS 10.20.045, 19.08.260 AND 19.08.261 OF THE MARYSVILLE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1.Section 10.20.045 of the Marysville Munici- pal Code is hereby amended to provide as follows: Kennel Permit Required.No person shall keep dogs and/or cats over three (3)months of age which total over four (4)in number on a single lot or unit of adjoining lots within the City without first obtaining a conditional use permit from the Board of Adjustment for a "private kennel"or· "commercial kennel"as defined in Chapter 19.08. Provided,that no such permit shall .be required in the case of a legally established commercial enterprise which operates exclusively as a veter- inary hospital or clinic,pet shop or grooming parlor. Section 2.Section 19.08.260 of the Marysville Munici- pal Code is hereby amended to provide as follows: Kennel,Commercial."Commercial kennel"means any lot or unit of adJoining lots in the City on which a total of more than four (4)dogs and/or cats,or a combination of the same,over three (3)months of age are kept and/or maintained for board,propagation, training or treatment.Such kennel must be estab- lished on a minimum of five (5)acres.Provided, that the term "commercial kennel"shall not apply to legally established commercial enterprises which operate exclusively as veterinary hospitals or clinics,pet stores or grooming parlors. Ordinance - 1 Section 3.Section 19.08.261 of the Marysville Munici- pal Code is hereby amended to provide as follows: Kennel,Private."Private kennel"means any lot or unit of adjoining lots in the City on which a total of more than four (4)dogs and/or cats,or a combin- ation of the same,over three months of age are kept. Provided,that such animals must be owned by the occupants of the property and must be kept primarily for the use and enjoyment of said occupants,includ- ing but not limited to,the raising of the animals for show purposes.
