AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF POMONA AVENUE AND VESTING O~mERSHIP THEREOF IN THE ABUTTING PROPERTY rn~ERS. mIEREAS,On October 22,1984 The City of ~1arysville received a petition to vacate that portion of Pomona Avenue situated between Blocks 8 and 9,and Blocks 4 and 5 of Aubury's first addition to Marysville,according to the Plat thereof recorded in Volume 2 of Plats page 77,~ecords of Snohomish County Auditor;and WHEREAS,On November 26,1984 and December 10,1984 public hearings were held on said Petition,and the City Council entered the following findings: (a)The said portions of Pomona Avenue,with the exception of the intersection with 74th Street NE,have never been opened and constitute abandoned public right- of-way as defined in RCW 36.87.090. (b)The vacation of said portions of Pomona Avenue will not adversely affect the street pattern or circulation of the immediate area or the community as a whole. (c)The public need will not be adversely affected. (d)Said portions of Pomona Avenue are not contemplated or needed for future public use. (e)No abutting owner will become landlocked nor will access for any abutting owner be sUbstantially impaired. (d)There are no easements,express or implied,en- cumbering said portions of Pomona Avenue.
