CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.&."2.7, AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING CERTAIN PROPERTY WITHIN THE CITY LIMITS AND AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772. WHEREAS,JAMES H.MULLIGAN and JO ANN MULLIGAN,husband and wife,are the owners of certain real property located at 7527 -51st Avenue N.E.,Marysville,Washington,the same being legally described as follows: The North 4 acres of the Northwest quarter of the Northwest quarter of the Northwest quarter of Section 27,Township 30 North,Range 5 East,W.M.; EXCEPT the West one-half of the South one acre thereof;Situated in the County of Snohomish,State of Washington. WHEREAS,said owners have filed a petition with the City Clerk seeking a rezone of said property from the single-family class- ification to the medium-density,multiple-family classification;and WHEREAS,the City Planning Commission held a public hearing on said rezone on June 11,1985,and submitted formal Findings of Fact and a recommendation in favor of granting said rezone;and WHEREAS,the City Council held a public meeting on said rezone on June 24,1985,and determined that the recommendation of the Planning Commission was consistent with the public interest;NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.The Findings of Fact of the Planning Commission with respect to the rezone application relating to Meadow Park Apart- ments located at 7527 -51st Avenue N.E.,Marysville,Washington,are hereby adopted by reference,and said property is hereby rezoned from the single-family residential classification to the medium-density Ordinance - 1 multiple-family residential classification,sUbject to the conditions stated in Section 2 below. Section 2.This rezone is sUbject to the following special conditions,and default on any of the same shall result in automatic nullification of the rezone and reversion to the single-family resi- dential classification: (a)The property'shall be developed with no more than 45 dwelling units,all of which shall be devoted exclusively to housing the elderly (age 62 and over) or the handicapped,and such development will be administered pursuant to a program of the Farmers Home Administration. (b)At the time of development,the owner shall dedi- cate ten (10)feet of right-of-way to the City along the abutting frontage of 51st Avenue N.E. and 76th Street N.E. (c)There shall be no exit from the project onto 51st Avenue N.E.except for dwelling units 1-5 and 44 and 45. (d)A speed bump shall be installed in the parking lot area. (e)The property shall be developed in strict compliance with the site plan filed with the City Planning Com- mission on June 11,1985;provided,that the City staff shall be allowed to approve minor adjustments to said site plan if the same do not create any significant off-site impacts. (f)A stop sign shall be installed at the exit from the property onto 76th Street N.E. (g)All development of the subject property shall be in strict compliance with applicable City codes. Section 3.The Official Zoning Map of the City of Marysville, Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772, are hereby amended to reflect the reclassification of the above- described property to the medium-density,multiple-family residential classification.
