Home My WebLink AboutO-1441 - Rezone (Special)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO./51~1 AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING CERTAIN PROPERTY WITHIN THE CITY 'LIMITS AND AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772 WHEREAS,E~~UPTON and RON LOOP are the owners of the following- described property located at 6229 -47th Avenue N.E.,Marysville, Washington: Beginning at the Northwest corner of the Southeast quarter,Southeast quarter of Section 28,Township 30 North,Range 5 East,W.M.;Thence South 306 feet to the Point of Beginning;Thence East 771 feet; Thence South 86 feet;Thence West 771 feet;Thence North 86 feet to the Point of Beginning;LESS County road:Situated in Snohomish County,Washington. WHEREAS,said owners filed a petition with the City Clerk seeking a rezone of said property from the Single-Family Residential classi- fication to the Multiple-Family,Medium-Density classification;and WHEREAS,the City Planning Commission held public hearings on said rezone on September 24,1985,October 8,1985,and October 22, 1985,and submitted formal Findings of Fact and a recommendation in favor of rezoning said property to the Multiple-Family,Low-Density Residential classification;and WHEREAS,the City Council has reviewed said Findings of Fact and recommendation,and finds that the rezone is in the public interest and is consistent with the Comprehensive Plan;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.The Findings of Fact of the Planning Commission with respect to the Rezone Application of EMMA UPTON and RON LOOP are hereby adopted,and the above-described property is hereby rezoned from the Single-Family Residential classification to the Multiple-Family,Low- Density classification. Ordinance - 1 Section 2.The Official Zoning Map of the City of Marysville, Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772, are hereby amended to reflect the reclassification of the above- described property. Section 3.This ordinance,and the rezone of the subject property which is implemented hereby,are conditioned upon strict compliance by the owner with the following conditions: All development of the property shall be in conformance with the site plan accepted by the City Planning Commis- sion on October 22,1985,a copy of the same being on file with the City Compliance Officer.The parcel in the northwest corner,which is excepted from the site plan,shall-not be developed until a site plan for said parcel is submitted for review and approval by the Planning Commission.A fence shall be constructed for the full length of the southern boundary of the excepted parcel.
