AN ORDINANCE OF THE CITY OF ,MARYSVILLE REZONING
CERTAIN PROPERTY WITHIN THE CITY LIMITS AND
AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY
ADOPTED IN ORDINANCE NO.772
WHEREAS,FRANK M.TAYLOR is the owner of the following-described
property located at 6111 -64th Street N.E.,Marysville,Washington:
The South half of the Northwest quarter of the
Southeast quarter of Section 27,Township 30
North,Range 5 East,W.M.;LESS the West 12
feet;Situated in Snohomish County,Washington.
WHEREAS,said owner filed a petition with the City Clerk seeking
a rezone of said property from the Single-Family Residential classi-
fication to the Multiple-Family,Medium-Density classification with a
mobile/manufactured-home-park zoning overlay for the northerly 14.48
acres;and
WHEREAS,the City Planning Commission held a public hearing on
said rezone on August 27,1985,and submitted formal Findings of Fact
and a recommendation in favor of rezoning said property to the Multiple-
Family,Medium-Density classification with a mobile/manufactured-home-
park zoning overlay for the northerly 14.48 acres;and
WHEREAS,the City Council has reviewed said Findings of Fact and
recommendation and finds that the rezone is in the public interest and
is consistent with the Comprehensive Plan;NOW,THEREFORE,
THE CITY COUNICL OF THE CITY OF MARYSVILLE,WASHINGTON,DO ORDAIN
AS FOLLOWS:
Section 1.The Findings of Fact of the Planning-Commission with
respect to the Rezone Application of FRANK M.TAYLOR are hereby adopted,
and the above-described property is hereby rezoned from the Single-
Family classification to the Multiple-Family,Medium-Density classifi-
cation with a mobile/manufactured-home-park zoning overlay for the
northerly 14.48 acres.
Section 2.The Official Zoning Map of the City of Marysville,
Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772,
are hereby amended to reflect the reclassification of the above-
described property.
Ordinance - 1
Section 3.This ordinance,and the rezone of the subject prop-
erty which is implemented hereby,are conditioned upon strict com-
pliance by the owner,his successors and assigns,with all terms and
conditions of a concomitant rezone contract which has been executed
by the owner and the City of Marysville and recorded in the"records
of the Snohomish County Auditor.The terms and provisions of said
contract are hereby adopted by the City Council and incorporated herein
by this reference.

WHEREAS,on November 12,1985 Frank M.Taylor and the city
of Marysville entered into an agreement entitled "Rezone
Covenants and Agreement,"the same being recorded in the records
of the Snohomish County Auditor under File No.8511140130;and
WHEREAS,said agreement related to a proposed development
known as Woodgate Village which had been approved by enactment of
city of Marysville rezone Ordinance No.1442 on November 12,
1985;and .

expired and the parties desire to rescind the Rezone Covenants
and Agreement and to clear the same from the public records;NOW,
THEREFORE,
IT IS HEREBY DECLARED that the Rezone Covenants and
Agreement referred to above is RESCINDED and is no longer of any
force or effect.

THIS AGREEMENT is entered into this 12th day of November
1985,by FRANK M.TAYLOR,P.O.Box 1582,Lynnwood,Washington 98036,
.hereinafter referred to as "Owner";
WITNESSETH:
WHEREAS,Owner owns fee title to 18.98 acres of real property
located at 6111 -64th Street N.E.,Marysville,Washington,said
property being legally described as follows:
The South one-half of the Northwest one-quarter
of the Southeastone-quarter'of Section 27,
Township 30 North,Range 5 East,W.M;,Snohomish
County,Washington,LESS the West 12 feet;
WHEREAS,the Owner proposes to develop said property with multip1e-
family dwelling units and a mobile home park,the same to be known as
"Woodgate Village";and
WHEREAS,the Owner has requested that the.CITY OF MARYSVILLE
rezone the property to the Medium-Density,Multiple-Family Residential
classification with a mobile'home park zonin~overlay for the northerly
14.48 acres;and
WHEREAS,pursuant to Chapter 19.30 of the Marysville Municipal
Code,the Owner has agreed to develop said property strictly in
accordance with plans which are approved by the CITY OF MARYSVILLE,
and to comply with certain standards,conditions and requirements
which shall be documented herein and hereafter considered to be an
integral part of the zoning restrictions applicable to the subject
property;
NOW,THEREFORE,the Owner hereby declares that all real property
described above shall be held,sold and conveyed subject to the fol-
lowing restrictions,covenants and conditions,and the same shall run

with the real property and be binding upon all parties having any
right,title or interest in the same,~heir heirs,successors or
assigns,and inure to the benefit of the CITY OF MARYSVILLE.
1.Preliminary Site Plan ..On August 27,1985,the city
Planning Commission approved a preliminary Site Plan for the
development of the subject property.Said Site Plan relates to the
construction of twelve (12)duplexes on 'the southerly 4.5 acres and
.construction of a mobile home park with ninety-four (94)units on
the northerly 14.48.This Site Plan shall establish the parameters
for the Binding Site Plan which the Owner shall submit for approval
prior to commencing development·activity.
2.Binding Site Plan.Before development activities commence
on any phase of the subject property,the Owner shall submit a Bind-
ing Site Plan with respect to each such phase which meets the require-
~ents of Section 19.30.070(b)of the Marysville Municipal Code.The
City staff shall review the Binding Site Plan for each phase to determine
whether it conforms to the approved Preliminary Site Plan,the Rezone
Ordinance,and the applicable State laws and City codes which were in
effect at the time of the rezone approval.The Binding Site Plan for
each phase shall be subjec~to approval by .the Mayor,or in the Mayor's
discretion,it may be referred to the City Council for final acceptance.
An approved Binding Site Plan shall constitute an integral part of the
rezone of the subject property and shall be binding upon the owner of
the property,his heirs,suc ces so r s and assigns.All development of
the property shall be consistent with the Binding Site Plan.
3.Dedications to the City.The Owner shall dedicate the f~llow
ing property to the CITY OF MARYSVILLE at no .cost to the City:
(a)The South 20 feet of the subject property for its full
abutting frontage along 64th Street N.E.,for public
right-of-way purposes;
(b)60 feet of.right-of-way for 60th Avenue N.E.,and.5.0 feet of
right..,.of-way for.the East-West Public Road,as shown on the
Preliminary Site Plan.
All such dedications shall grant the City free and clear title to the
affected property,and the Owner shall warrant the City's title to .
the same.Dedications shali occur at such time as the sarne are requested
by the City,but in no event shall occupancy of any dwelling unit on
the subject property be permitted prior to such dedications being com-
pleted..
4.Street Improvements.
(a)64th Street N.E.:64th Street N.E.requires the following
improvements:

Establishment of aD-foot right-of-way;
construction of curbs,gutters and sidewalks
on both sides;
Construction of a 56-foot-wide street from
curb to curb;
Construction of a storm sewer system;and
Installation of necessary street lighting
facilities.
The Owner shall meet its responsibility with respect to
said street improvements ih either of the following
alternative ways:
(1)Voluntarily participate in a local improvement .dis-
trict for 64th Street N.E.A petition for the for-
mation of such a local improvement district must be
signed on or before January 1,1986,and the L.I.D.
must be formed prior to occupancy of any dwelling
units on the subject property;or
(2)At its own cost,the Owner may construct the north
half of 64th Street N.E.,including curbs,gutters,
sidewalks,storm sewers and street lighting facil-
ities along the full abutting frontage.of the sub-
ject property.'Said construction shall include some
improvements on the south side of the centerline'
where the street grade so requires,as determined
by the City.All such construction shall be com~
pleted prior to occupancy of any dwelling units on
the subject property ..
(b)60th Avenue N.E.:Prior to occupancy of any dwelling units
on the subject property,the Owner,at its own cost,shall
construct 60th Avenue N.E.and dedicate the same to the City
as a public street.Construction shall conform to CITY OF
MARYSVILLE Street Design Exhibit "A."·
(c)East-West Public Road:Prior to occupancy of any dwelling
units on the subject property,the Owner,at its own cost,
shall construct an east-west road as shown on the Prelim-
inary Site Plan,and dedicate the same to the City as a
public street.Construction shall conform to CITY OF
MARYSVILLE Street Design Exhibit "E."
(d)Private Roads:Private roads within the mobile horne park
shall be constructed per the Site Plan,and in compliance
with the requirements of the City Engineer and Section
19.30.080(f)of the Marysville Municipal Code.

5.Fencing.Prior to occupancy of any dwelling units on the
subject property,the Owner shall construct a six-foot-high sight-
obscuring fence along the full abutting frontage of 64th street N.E.
Other fences around'the perimeter of the site shall'be constructed'
in accordance with the site plan on a phasing schedule to be approved
by the City Compliance Officer.
6.Recreational Improvements.The Owner shall construct
recreational improvements within the mobile horne park consisting of
a park,tot lot,recreation building,and sports court.Said improve-
ments shall be constructed on a phasing schedule approved by the City
Compliance Officer.'
7.Design and Performance Standards.The design standards for
mobile horne parks specified in Section 19.30.080 of the Marysville
Municipal Code are hereby adopted and incorporated by this reference.
All development and occupancy of the northerly 14.48 acres of the
sUbject property shall be in strict compliance with said design stan-
dards.
8.Park Administration.The requirements of Section 19.30.090
of the Marysville Municipal Code relating to park administration,
including the requirementof.a full-time resident manager,are adopted
and incorporated herein by this reference.
9.Compliance with Laws.The development and occupancy of the"
sub j ect property shall be in strict compliance with all applicable ordin-
ances of the CITY OF MARYSVILLE and other jurisdictional authorities.
10.Phasing.Development of the subject property may be divided
into phases subject to approval of the City Compliance Officer.
11.Duration of Approval.The rezone of the subject property to
the Medium-Density Multiple-Family Residential classification,wl.th a
mobile horne park zoning overlay for the northerly 14.48 acre~shall be
contingent upon development of the slibjectproperty in compliance with
this contract and the Binding Site Plan within three years of the date
of the rezone ordinance (November 12,1985).Provided,that upon
application,by the Owner,a one-year extension may be granted by the
City Council pursuant to the terms and conditions specified in Section
19.30.050(f)of the Marysville Municipal Code.If development ,is not
completed withiri the time peri6d provided,the zoning of the subject
property shall revert to Single-Family Residential,and the rezone
ordinance and ,this contract shall be considered void and of no further
force or effect.
IN WITNESS WHEREOF the Owner has caused these presents to be
