Home My WebLink AboutO-1467 - Rezone (Special)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.19~'/ '" AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING CERTAIN PROPERTY WITHIN THE CITY LIMITS AND AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772 WHEREAS,FLORENCE LYONS and O'CONNOR AND OEHLER CONSTRUCTION, INC.,(hereinafter referred to as "Owner"),own the following-described property located at 4504 and 4518 -76th Street N.E.,Marysville,Washington: The north 3/5 of the North half of the Northeast quarter of the Northwest quarter of the Northeast quarter of Section 28,Township 30 North,Range 5 East,W.M.;LESS the East 450 feet thereof;LESS public right-of-way on the North;Situated in the County of Snohomish,State of Washington. WHEREAS,said Owner filed a petition with the City Clerk seeking a rezone of said property from the Single-Family Residential classification to the Medium-Density Multiple-Family Residential classification;and WHEREAS,the City Planning Commission held a public hearing on said rezone on February 11,1986,and because of a tie vote was unable to submit a recommendation regarding said rezone;and WHEREAS,the City Council held a public hearing on said rezone on April 14,1986,and finds that the rezone is in the public interest and is consistent with the Comprehensive Plan; NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section I.The above-described property is hereby rezoned from the Single-Family Residential classification to the Medium-Density Multiple-Family Residential classification. Section 2.The Official Zoning Map of the City of Marysville~-Washington,as adopted in 1972,and Section 5.02 of Ordinance No.772,are hereby amended to reflect the reclassification of the above-described property. Section 3.This ordinance,and the rezone of the sUbject property which is implemented hereby,are conditioned upon strict compliance by the Owner,its heirs,successors and assigns,with the following requirements: (a)Prior to development the Owner shall dedicate ten (10) feet of right-of-way to the City along the abutting frontage on 76th Street N.E. (b)Prior to occupancy,the Owner shall construct fencing along the full length of the east,west and south boundary lines of the subject property. (c)All development on the subject property shall conform to the site plan and building design submitted as an exhibit to the City Council on April 14,1986.
