WHEREAS,on June 23,1986,and again on July 14,1986,public
hearings were held on said petition,.and the City Council entered
the following findings:
1.The vacation of the above-described portions of Tenth
Street N.E.will not adversely affect the street pattern or circu-
lation of the immediate area or the community as a whole.
2.The public need will not be adversely affected.
3.The above-described portion of Tenth Street N.E.is not
contemplated or needed for future public use.
4.No abutting owner will become landlocked,nor will access
for any abutting property be substantially impaired by the proposed
vacation.
Based upon the foregoing findings,the City Council of the
City of Marysville,Washington do ordain as follows:

the same is hereby vested as follows:

section 2.The appraised value of those portions of Tenth
Street N.E.which are being vacated by this Ordinance are hereby
established as follows:
Parcel 1 $3,215.36
Parcel 2 $6,274.98
Each abutting property owner shall be required to pay 50%of
the appraised value of the parcel being acquired by said property
owner.
Section 3.This Ordinance shall not become effective until
the sum specified above has been paid in full to the City by both
of the abutting property owners.Publication of this Ordinance,
and filing of the same with the Snohomish County Auditor and the
Snohomish County Assessor,shall constitute an acknowledgement by
the City that said sums have been paid in full and this Ordinance
has become effective.
PASSED by the City Council and APPROVED by the Mayor this
14th day of July ,1986.

On July 14,1986,the Marysville City Council adopted
Ordinance No.1479 vacating a portion of 10th Street N.E.
to the abutting property owners.A condition of this vaca-
tion was that you pay 50%of the appraised value of the
portion of 10th Street N.E.that was to be vacated.The.
appraised value of your parcel was $6,274.98;SOlo of this
would be $3,137.49.
As of this date we have not received your payment
of $3,137.49.Until this payment is in our office Ordinance
No.1479 will not be published and therefore will not be
in effect.
If you have any questions regarding this matter do

from you I will assume that your payment will be in my
office in the near future.

adopted Ordinance No.1479 vacating a portion of 10th
street N.E.to the abutting property owners (Oby &
Lenora Richardson and Jack Telford).A condition of this
vacation was that the abutting property owners pay 50%
of the appraised value of the portion of 10th street
that was to be vacated.
The appraised value of the Richardson1s portion was
$3,215.36;50%of this would be $1,607.68.The
Richardson1s portion HAS been paid.
The appraised value of your portion was $6,274.98;
50%of this would be $3,137.49.This HAS NOT been paid.
Ordinance No.1479 will not be published until ALL
payments are received by the City.The Ordinance will
not be effective unless it is pUblished.
If payment is not received from you by March 18,
1987,this matter will be place on the City Council's
March 23,1987,agenda for reconsideration.
