CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.1520 AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING SECTION 12.02.170 OF THE MARYSVILLE MUNICIPAL CODE RELATING TO THE REQUIREMENT THAT PROPERTY OWNERS CONSTRUCT CURBS,GUTTERS AND SIDEWALKS AT THE TIME OF DEVELOPING THEIR PROPERTY THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 12.02.170 of the Marysville Municipal Code is hereby amended to provide as follows: Curbs,gutters,and sidewalks required. (a)Property owners shall be required to construct, reconstruct,or repair curbs,gutters and sidewalks,to City specifications,along all pUblic street frontage abutting lots which are being developed in any of the following ways: (1)Formal Plats.Curbs,gutters and sidewalks shall be completed prior to recording the final plat, or may be bonded pursuant to the provisions of Title 20. (2)Short Plats.Curbs,gutters and sidewalks shall be completed for frontage abutting all lots prior to the issuance of a building permit for any lot in the short plat. (3)Construction of a dwelling unit,or a busi- ness,commercial or industrial building.Curbs, gutters and sidewalks shall be completed prior to occupancy of said building. (4)Construction of any additions,alterations or repairs to a dwelling unit,or to a business, commercial or industrial building,within any twelve-month period,which exceed 50%of the value of the existing building on the property.Curbs, gutters and sidewalks shall be completed prior to occupancy. (5)Development of a mobile home park or other project requiring a binding site plan.Curbs,gutters and sidewalks shall be completed prior to occupancy. (6)Any change in the occupancy classification of an existing building or structure on the property. Curbs,gutters and sidewalks shall be completed prior to occupancy. (b)In cases where the property owner is required by subsection (a)above to reconstruct or repair an inadequate,broken or defective sidewalk,application may be made to the City Counci~for a variance allowing the continuation of a previously existing inadequate sidewalk width under circumstances where the same would not be detrimental to the pUblic health,safety or welfare,or contrary to the long-term pUblic interest. There shall be no charge for this variance application. (c)In the case of residential construction on a single lot,a property owner may satisfy the requirements of subsection (a)above by participating in a cost- sharing program with the City if the same is approved in the then-current budget of the City Council.
