HomeMy WebLinkAboutO-1588 - Adds Sec. 19.20.070, zoning (Repealed by 2131)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.1588 AN ORDINANCE OF THE CITY OF MARYSVILLE ADDING A NEW SECTION TO CHAPTER 19.20 OF THE MARYSVILLE MUNICIPAL CODE RELATING TO RESIDENTIAL USE OF SUBSTANDARD LOTS. THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: A new Section 19.20.070 of the Marysville Municipal Code is hereby enacted to provide as follows: 19.20.070 Residential Use of Substandard Lots.In any zone allowing residential uses,a single family dwelling may be established on a lot which cannot satisfy the bulk or dimensional requirements under the following circumstances: a.In cases where the lot in question has a residence which has been occupied within the past 24 months,but said residence has been destroyed by accidental cause,condemna- tion or voluntary demolition,the provisions of Chapter 19.40 relating to reconstruction of non-conforming buildings shall apply. b.In cases of vacant lots which have not been previously occupied,construction of a single-family dwelling shall be allowed if the following criteria are met: i.The lot was established by a conveyance of record prior to 1970 and its dimensions have not been modified since said conveyance;or the lot was created by an approved plat and satisfied the bulk and dimen- sional requirements applicable at the time of its creation;and 11.The lot has not lost its independent status by being developed and occupied in conjunction with an adjoining lot under single ownership,thereby merging the lots ,as a single unit;and iii.The lot is not less than 5,000 square feet in size,or such greater size as may be required by the Snohomish Health District if an on-site sewage disposal system is involved;provided,that this lot size requirement is subject to waiver by the City Council in hardship cases,using the variance criteria sPecified in Section 19.44.040;and ' Ordinance - 1 iv.Development of the lot will comply with all bulk and dimensional regulations in this Chapter relating to setbacks,maximum lot coverage and off- street parking,as said regulations exist on the date of application for development permits. :~PASSED b~y Council and APPROVED by the Mayor this 1 \~day of ~'~~~~~'1988.
