AN ORDINANCE OF THE CITY OF MARYSVILLE DECLARING THE
TERMINATION OF LID *63 BY PROTEST,AND REPEALING
ORDINANCE 1586.
WHEREAS,on December 14,1987 the Marysville City Council
adopted Ordinance 1586 establishing Local Improvement District
*63 relating to the construction of 64th Street N.E.;and
WHEREAS,written protests have been received from property
owners within the unincorporated portion of the LID boundaries
who represent 67.52%of the preliminary assessment roll relating
to said unincorporated portion;and
WHEREAS,pursuant to RCW 35.43.180 a protest of this
magnitude automatically divests the City of jurisdiction to
proceed with the Local Improvement District as a whole;NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1.The City hereby declares that LID *63 is
terminated by reason of a 67.52%protest filed pursuant to RCW
35.43.180 by property owners within the unincorporated portion of
the LID boundary.
Section 2.Ordinance 1586 adopted by the City Council on
December 14,1987 and entitled as follows:
"An ordinance ordering the improvement of a portion of
64th Street N.E.,all in accordance with resolution
*1280 of the City Council;establishing Local Improve-
ment District No. 63 and ordering the carrying out of
the proposed improvements;providing that payment for
the improvement be made in part by special assessments
upon the property in the district,payable by the mode
of "payment by bonds";and providing for the issuance
and sale of local improvement district warrants
redeemable in cash or other short-term financing and
local improvement district bonds."
IS HEREBY REPEALED.
