AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
WINDSOR PARK PROPERTY AND AMENDING THE OFFICIAL ZONING
MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772
WHEREAS,Marysville Associates,by its general partner,Ray
Walker,and David B.Jones and Janice L.Jones,husband and wife
(hereinafter referred to as "Owners"),own certain property
located.on the southwest corner of 100th Street N.E.and 48th
Drive N.E.,said property being legally described in Exhibit A
attached hereto;and
WHEREAS,said Owners filed a petition with the City Clerk
seeking a rezone of said property from the Residential 7200
Classification to the High Density MUltiple Family Classifica-
tion;and
WHEREAS,the City Planning Commission held public hearings
on said rezone on May 10,1988,June 28,1988 and July 12,1988
and adopted formal findings of fact and a recommendation that the
subject property be rezoned-as requested;and
WHEREAS,the City Council held a public meeting on said
rezone on August 1,1988 and finds that the rezone is in the
public interest and is consistent with the Comprehensive Plan;
NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1.The findings of fact of the Planning Commission
with respect to the above~referenced rezone application are
hereby adopted and the above-described property is hereby rezoned
from the Single Family Residential 7200 Classification to the
High Density Multiple Family Classification subject to a con-
comitant rezone agreement.
Section 2.The official zoning map of the City of Marys-
ville as adopted in 1972,and Section 5.02 of Ordinance No.772,
are hereby amended to reflect the reclassification of the above-
described property.
Section 3.This ordinance,and the rezone of the subject
property which is implemented hereby,are conditioned upon strict
compliance by the Owners with all terms and conditions of a

concomitant rezone agreement entered into between the Owners and
the City and recorded in the records of the Snohomish County
Auditor.
