HomeMy WebLinkAboutO-1632 - Repeals and replaces Sec. 12.02.170, street department code (Repealed by 2724)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.{b 3~ AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING SECTION 12.02.170 OF THE MARYSVILLE MUNICIPAL CODE RELATING TO PUBLIC STREET FRONTAGE IMPROVEMENTS REQUIRED AT THE TIME OF DEVELOPMENT PERMITS. THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Section 12.02.170 of the Marysville Municipal Code,entitled "Curbs,Gutters and Sidewalks Required"is hereby REPEALED for the reason that the same is superseded by Section 2 of this Ordinance. Section 2.A new Section 12.02.170 of the Marysville Municipal Code is hereby enacted to provide as follows: 12.02.170 Frontage Improvements Required. (a)The term "frontage improvements"as used herein shall refer to the construction,reconstruction or repair of the following facilities along the full abutting public street frontage of property being developed: Curbs,gutters and sidewalks. Underground storm drainage facilities. Patching the street from its pre- existing edge to the new curb line. Overlayment of the existing public street to its centerline. All such frontage improvements shall be constructed to City specifications. (b)Property owners shall be required to construct frontage improvements along the full abutting public street frontage of property which is developed as provided in subsection (c)below.Provided,that overlayment of an existing public street to its centerline shall not be required for single family or duplex development. (c)Frontage improvements shall be constructed as follows: ORDINANCE - 1 (1)Formal plats:Frontage improve- ments shall be completed prior to recording the final plat,or may be bonded pursuant to provisions of Title 20. (2)Short plats:Frontage improvements shall be completed for frontage abutting all lots prior to the issuance of a building permit for any lot in the short plat. (3)Construction of a dwelling unit, business,commercial or industrial building: Frontage improvements shall be completed prior to occupancy of the building. (4)Construction of any additions, alterations or repairs to a dwelling unit,or to a business,commercial or industrial building within any twelve-month period, which exceed 50%of the value of the existing building on the property:Frontage improve- ments shall be completed prior to occupancy. (5)Development of a mobile home park or other project requiring a binding site plan:Frontage improvements shall be completed prior to occupancy. (6)Any change in the occupancy classification of an existing building or structure on the property:Frontage improve- ments shall be completed prior to occupancy. (d)In the case of single family residential construc- tion on a single lot,a property owner may satisfy the frontage improvement requirements by participating in a cost-sharing program with the City if the same is approved in the then-current budget of the City Council. (e)The Director of the Department of Public Works shall have authority to grant administrative variances from any of the requirements of this Section on technical grounds of engineering feasibility or necessity.Such variances may be conditioned upon the property owner signing a contract to construct the frontage improvements at a future time.Any party aggrieved by a decision of the Director may appeal the same to the City Council.The City Council shall have authority to grant variances from any of the requirements of this Section pursuant to the procedures specified in Section 12.02.110.
