HomeMy WebLinkAboutO-1652 - Adds Sec. 19.16.040; amends Sec. 19.16.010, zoning (Repealed by 2131)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.J ~S?- AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING SECTION 19.16.010 (TABLE OF PERMITTED USES)OF THE MARYSVILLE MUNICIPAL CODE BY ADDING AND DELETING CERTAIN LAND USES,AND AMENDING SECTION 19.16.040 TO LIMIT THE LOCATION OF ENTERTAINMENT CLUBS. THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Section 19.16.010 of the Marysville Municipal Code (Table of Permitted Uses)is hereby amended by REPEALING the following land uses: Abattoirs Agencies as follows,rendering specialized services not involving retail trade with the general public nor maintenance of a stock of goods for sale:real estate,insurance,advertising, brokerage. Airports and landing fields Automobile laundry Billboards as defined in Section 19.08.040 Convalescent and nursing homes and homes for the care of children or the aged Cooperage works Garbage and waste incineration Jails and penal institutions Landfills,sanitary,for disposal of stumps,trash and garbage. Landfills,reclamation to improve steep,low or otherwise unusable land. Marquee,as permitted by building code with sign or signs. Ordinance - 1 Residential uses:All uses permitted in any residential district as set forth in this table may be continued as nonconforming uses as provided in Sections 19.08.330,19.08.335 and 19.08.340, and further may be established or changed to other such residential use;provided such use is carried on within pre-existing buildings occupied by or designed for any residential use at the time of the establishment of the industrial and commercial districts;and provided that any building and plot containing one or more dwelling units shall comply with the dimensional requirements of the RS District set forth in Chapter 19.20. Signs,illuminated or otherwise,as regulated in Chapter 19.20,but not billboards. Signs,as regulated in Section 19.20.010 and Chapter 16.16. Signs:A small,permanent,professional or announcement sign,unilluminated,not over three (3)square feet in area,mounted flat to the main wall of the building and an unilluminated tem- porary real estate sign not over six (6)square feet in area,mounted or displayed behind the building setback line. Signs:Marquee as permitted by a building code with sign or signs. Signs designed to overhang a public sidewalk not more than three (3)feet and only if illuminated. Section 2.Section 19.16.010 of the Marysville Municipal Code (Table of Permitted Uses)is hereby amended to add the following land use categories: Dwellings used as communal or cooperative living facilities for persons whose independence is limited by age,disability,mental,physical or medical reasons,or who are victims of crime or domestic violence,but not including persons suffering from acute mental sickness or from contagious or communicable diseases: 3 residents per the equivalent of each minimum lot size allowed in the zone ••• a conditional use in all single family zones. Ordinance - 2 Higher occupancy facilities a conditional use in RML,RMM and RMH zones. Dwellings,facilities or institutions used by the criminal justice system as halfway houses or work release facilities: •.•A conditional use in the GI zone. Hazardous waste processing,handling,treatment or storage,provided that the same shall be consis- tent with the State siting criteria adopted pursuant to the requirements of Chapter 70.105 RCW •••A conditional use in the GI zone. Nursing,convalescent and retirement homes: 3 residents per the equivalent of each minimum lot size allowed in the zone ..• a conditional use in all single family zones. Higher occupancy facilities •••a condi- tional use in the RML,RMM,RMH,BN and BC zones. Retirement,nursing and convalescent homes: (See nursing,convalescent and retire- ment homes) Section 3.A new subsection is hereby added to Section 19.16.040 of the Marysville Municipal Code to provide as follows: (c)Entertainment clubs,as defined in Chapter 5.20 of this Code,shall not be located within 500 feet of any Single-Family or Multiple-Family Residential zone.For the purpose of measuring this distance a straight line shall be followed,without regard to intervening buildings,from the nearest point of the entertainment club property to the nearest point of a residential zone.
