The City Council of the City of Marysville,Washing- ton,do ordain as follows: section 1.Since the adoption of the 1989 budget by the City Council on December 12,1988,it has been determined that the interests of the residents of the City of Marysville may best be served by the increase and/or decrease of certain revenues and/or expenditures.The following bUdgeted rev- enues and expenditures as they appear in the 1989 Budget are hereby revised as follows: Federal Revenue Sharing Fund No.110 REVENUE 308.00.00 APPROPRIATIONS 110.04.555.00.41 110.04.594.14.64 110.10.574.20.41 110.10.594.76.64 110.12.594.72.64 Est.Cash Bal.1/1/89 Professional Services Machinery &Equipment Professional Services Machinery &Equipment Machinery &Equipment INCREASE $27,674 7,750 7,808 10,000 1,616 500 DECREASE section 2.Whereas these budgetary changes could not reasonably be anticipated at the time of the adoption of the 1989 BUdget,an emergency is hereby declared to exist. City of Marysville Ordinance No.t b 7 q Page 2 of 2 PASSED this ty"tlt day of by the City Council and APPROVED by the Mayor THE CITY OF MARYSVILLE APPROVED ASaFORM: tiY At~rney c '-'8~ ",I City of Marysville Marysville,Washington Findings of Fact and Conclusions on Rezone Application The City Council of the City of Marysville having held a duly-advertised public hearing March 6,1989 regarding an amendment to the binding site plan as set forth in the Zoning and Development Agreement adopted by Or- dinance No.1426 which rezoned certain property described therein,and having considered the exhibits,testimony and arguments presented,and be- ing fully advertised in the premises,does hereby enter the following: Findings of Fact 1.The property is owned by and between Olde West,a limited partner- ship,Dick Pedersen,a general partner,Marysville Olde Nursery,a limited partnership,Dick Pedersen,a general partner. 2.The subject property is presently zoned Medium Density Multiple Fam- ily Residential (RMM).Surrounding land use includes apartments to the north,Marys Olde Nursery to the east,lumber yard to the south, and construction storage yard to the west. 3.The zoning "Z.7clttJ'/lU4-o11u£Le y cia 1 . property to of the area to The property to the east is zoned the west and south is zoned the north is zoned Multi-family Planned Community Business. General and the 4.The Marysville Comprehensive Plan for the property is Light Indus- trial. 5.The property is approximately 1.89 acres in area. 6.The applicant is requesting that the Zoning and Development Agreement concomitant with Ordinance No.1426 be amended pursuant to the Binding Site Plan section which states that any amendment of ma- terial nature to the concept of said plan and all amendments which would have a potential impact on the surrounding community must be approved by the City Council. 7.A Determination of Non-Significance pursuant to SEPA has been previ- ously issued for this proposal. 8.If the amendment to the binding site plan is granted the following conditions should be imposed upon the subject property; a.Development of the subject property shall occur as shown on the approved site plan. b.The Zoning and Development Agreement concomitant with Ordinance No.1426 shall be revised and signed by the property owner(s)to reflect the change in dwelling unit density from 40 to 36 units; the section entitled Limitation on Commercial Uses shall be removed from the agreement;and Findings of Fact page 2 Marysville Olde Nursery/Pedersen c.The site plan shall become binding through the concomitant agreement. Conclusions 1.The applicant has demonstrated a change in circumstances justifying the requested amendment to the Zoning and Development agreement con- comitant with Ordinance No.1426. 2.The proposed change in the use of the property is consistent with the public interest,and with the present or projected development needs and goals of the City,as specified in the Comprehensive Plan. 3.Approval of the requested binding site plan amendment and subsequent use of the land should be granted subject to the conditions stated in paragraph 8 above.
