AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
BAYVIEW CREST PROPERTY AND AMENDING THE OFFICIAL ZONING
MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,Campaco Washington Limited Partnership (hereinafter
referred to as "Owner")owns certain property known as the Plat
of Bayview Crest,said property being legally described as
follows:
The south half of the north half of the northeast
quarter,section 26,Township 30 North,Range 5 East,
W.M.;EXCEPT that portion lying easterly of the
easterly line of the Olympic Pipeline Company right-of-
way as recorded under AUditor's File No.2277405;
EXCEPT beginning at a point on the west line of said
subdivision 220 feet north of the southwest corner;
thence southeasterly 250 feet to a point on the south
line of said subdivision 120 feet east of the west line
of said subdivision;
situate in the County of Snohomish,State of
Washington.
WHEREAS,the Owner filed a petition with the City Clerk
seeking a rezone of said property from the Single Family
Residential 12,500 classification to the PRD 12,500 classi-
fication under file number PA 8812066;and
WHEREAS,the city Planning Commission held public hearings
on said rezone on February 14,1989 and March 28,1989 and
adopted formal findings of fact and a recommendation that said
rezone request be granted;and
WHEREAS,the City Council held a pUblic meeting on said
rezone on May 1,1989 and concurred with the findings of fact and
recommendation of the Planning Commission;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
ORDINANCE - 1
hereby approved and the above-described property is hereby
rezoned from the Single Family Residential 12,500 classification
to the PRD 12,500 classification.
section 2.This rezone is subject to the following
conditions:
1.All conditions of the preliminary plat
approval for the Plat of Bayview Crest are incorporated
herein by this reference.
2.All conditions of the staff recommendation for
this PRD/plat dated February 8,1989 are incorporated herein
by this reference.
3.The Owner shall fully comply with TIP 89-1.
4.The Owner shall fully comply with TIP 89-2 (to be
adopted).
5.The Owner shall construct recreational improve-
ments in the open space within the plat per the requirements
of the City Parks Department,including,at a minimum,
fencing on the east side of the property and construction of
a trail system in the open space areas.
6.The Owner shall participate on a proportionate
share basis in the construction cost of the regional storm
water detention pond located in the Plat of Munson Creek,
and shall provide temporary on-site detention until such
detention pond is completed.If the detention pond is
within the jurisdiction of Chapter 14.8 of the Marysville
Municipal Code,the Owner shall pay a storm drainage
assessment of $425 per dwelling unit.
section 3.The Official Zoning Map of the city of Marys-
ville as adopted in 1972 in section 5.02 of Ordinance No.772,is
hereby amended to reflect the reclassification of the above-
described property.
