AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
WELLS/PIERCE PROPERTY AND AMENDING THE OFFICIAL ZONING
MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,Elaine Wells (hereinafter referred to as "Owner")
owns 1.6 acres of real property located one block south of Grove
Street on (and east of)the Columbia Avenue alignment,said
property being legally described in Exhibit A attached hereto;
and
WHEREAS,the Owner,and the Lessee of the property (Doris
Pierce),filed a petition with the City Clerk seeking a rezone of
said property from the Single Family Residential 7200 classi-
fication to the Medium Density MUltiple Family classification
under File No.PA 8901002;and
WHEREAS,the city Planning Commission held pUblic hearings
on said rezone on April 11,1989 and April 25,1989 and adopted
formal findings of fact and a recommendation that said rezone
request be granted;and
WHEREAS,the City Council held a public meeting on said
rezone on May 8,1989 and concurred with the findings of fact and
recommendation of the Planning Commission;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved and the above-described property is hereby
rezoned from the Single Family Residential 7200 classification to
the Medium Density MUltiple Family classification.
section 2.This rezone is sUbject to the following
conditions:
1.Prior to any development activity on the sUbject
property the Owner/Lessee shall obtain a Conditional Use
Permit from the Board of Adjustment authorizing the
construction of a batting cage/recreational facility.All
development of the site shall be in strict compliance with
the terms and conditions of said Conditional Use Permit.If

said Permit is denied or abandoned,this rezone shall
automatically be deemed null and void.
2.Prior to any development activity on the subject
property the Owner/Lessee shall dedicate 250 lineal feet of
60-foot-wide right-of-way to the City for the extension of
Columbia Avenue.Requirements regarding the improvement of
said pUblic right-of-way shall be imposed as conditions of
the Conditional Use Permit.
section 3.The official zoning map of the City of
Marysville as adopted in 1972 in section 5.02 of Ordinance No.
772 is hereby amended to reflect the reclassification of the
above-described property.
