ORDINANCE NO.16 q q
AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
CRYSTAL HEIGHTS PROPERTY AND AMENDING THE OFFICIAL
ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,EUGENE BASTYS and W.T.WITHERS (hereinafter
referred to as "Owner")own certain property known as the
Preliminary Plat of Crystal Heights,said property being legally
described as follows:
The northeast quarter of the northwest quarter,section
35,Township 30 North,Range 5 East,W.M.,Snohomish
County,Washington;EXCEPT the east 264 feet of the
west 294 feet of the south half of the south half of
the northeast quarter of the northwest quarter of
section 35,Township 30 North,Range 5 East,W.M.,
Snohomish County,Washington.
WHEREAS,the Owner filed a petition with the City seeking a
rezone of said property from the Single Family Residential 12,500
classification to the PRD 12,500 classification under File No.PA
8902009;and
WHEREAS,the City Planning Commission held a pUblic hearing
on said rezone on April 25,1989 and adopted formal findings of
fact and a recommendation that said rezone request be granted;
and
WHEREAS,the City Council held a pUblic meeting on said
rezone on May 22,1989 and concurred with the findings of fact
and recommendation of the Planning Commission;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved and the above-described property is hereby
rezoned from the Single Family Residential 12,500 classification
to the PRD 12,500 classification.
Section 2.This rezone is sUbject to the following
conditions:
ORDINANCE - 1
1.All conditions of the preliminary plat approval
for the Plat of Crystal Heights are incorporated herein by
this reference.
2.All conditions of the staff recommendation for
this PRD/plat are incorporated herein by this reference.
3.At the time of recording the final Plat of Crystal
Heights the open space area designated therein as Tract A
shall be dedicated to the city of Marysville for city park
purposes.
4.Prior to occupancy of any structure in the Plat
the Owner shall construct a 6-foot-high chain link fence for
the full width of the north boundary of the property.
5.The Owner shall fully comply with TIP 89-2 (to be
adopted).
6.The Preliminary site Plan submitted by the Owner,
and filed under City File No.PA 8902009,is hereby adopted
pursuant to section 19.48.060(a)of the Marysville Municipal
Code.
7.The Owner shall participate on a proportionate
share basis in the construction cost of Regional Storm Water
Detention Ponds No.Hand H-1,and shall provide temporary
on-site detention until such detention ponds are completed.
If the detention ponds are within the jurisdiction of
Chapter 14.18 of the Marysville Municipal Code,the Owner
shall pay a storm drainage assessment of $425 per dwelling
unit.
8.The Owner shall participate on a proportionate
share basis in the construction cost of road improvements
along the east side of 67th Avenue N.E.which front on the
exception areas noted in EXHIBIT A attached hereto.
Construction of said improvements shall comply with the
schedule established by the Department of Public Works.The
Owner shall be entitled to a lien for latecomer contribu-
tions for said construction costs against the properties
fronting on the exception areas.Interest shall accrue at
10%per annum.
section 3.The Official Zoning Map of the city of
Marysville as adopted in 1972 in section 5.02 of Ordinance No.
772 is hereby amended to reflect the reclassification of the
above-described property.
