AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
REYA COMPANY PROPERTY AND AMENDING THE OFFICIAL ZONING
MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,REYA COMPANY (hereinafter referred to as "Owner")
owns certain property located at the northeast corner of 94th
Place N.E.and State Avenue (currently addressed as 4219 and 4225
94th Place N.E.),said property being legally described as
follows:
Lots 1 and 2,Plat of Wadehaven Division No.
1,as recorded in Volume 15 of Plats,page
67,records of Snohomish County,Washington.
WHEREAS,the Owner filed a Petition with the city seeking a
rezone of said property from the Single Family Residential 7200
classification to the Community Business Classification under
File No.PA 8903013;and
WHEREAS,the City Planning Commission had a pUblic hearing
on said rezone on May 9,1989 and adopted formal findings of fact
and the recommendation that said rezone request be granted;and
WHEREAS,the City Council had a pUblic meeting on said
rezone on June 5,1989 and concurred with the findings of fact
and recommendation of the Planning Commission;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved and the above-described property is hereby
rezoned from the Single Family Residential 7200 classification to
the Community Business classification.
section 2.This rezone is SUbject to the following
conditions:
1.All conditions of the staff recommendation for the
rezone are incorporated herein by this reference.

2.The site Plan presented to the city council on
June 5,1989 and filed in the records of the City Planning
Department is hereby adopted as a Binding site Plan for all
development on the sUbject property.
3.Prior to obtaining a building permit for the
subject property the Owner shall file a written agreement
with the city to pay the cost of a traffic light at the
intersection of 92nd street N.E.and state Avenue on a
proportionate share basis with all other developing
properties in the vicinity which have a direct traffic
impact on said intersection.The form of said agreement
shall be subject to approval by the City Attorney.
section 3.The official zoning map of the city of
Marysville as adopted in 1972 in section 5.02 of Ordinance No.
772 is hereby amended to reflect the reclassification of the
above-described property.
PASSED by the city council and APPROVED by the Mayor this
