AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
CRYSTAL TERRACE PROPERTY AND AMENDING THE OFFICIAL
ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,Oliver J.stone,Mary Stone and Metco Construction,
Inc.(hereinafter referred to as "Owner")own certain property
known as the Preliminary Plat of Crystal Terrace,said property
being legally described as follows:
The North half of the South half of the Northwest
quarter of the Northwest quarter of section 35,
Township 30 North,Range 5 East,W.M.;EXCEPT 67th
Avenue N.E.;situate in the County of Snohomish,State
of Washington;
and
WHEREAS,the Owner filed a petition with the City seeking to
establish a zoning classification for the property of PRD 9600
under File No.PA 8904017;and
WHEREAS,the City Planning Commission held a pUblic hearing
on said zoning application on May 23,1989 and adopted formal
findings of fact and a recommendation that the zoning application
be denied;and
WHEREAS,the City Council held a pUblic hearing on said
zoning application on June 26,1989 and found that a revised site
Plan proposed by the Owner was in the pUblic interest and
justified approval of the zoning application;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact contained in the staff
recommendation on file herein are hereby approved and the above-
described property is hereby zoned in the Single Family Residen-
tial PRD 9600 classification.
section 2.This zoning classification is subject to the
following conditions:
1.All conditions of the preliminary plat approval

for the Plat of Crystal Terrace are incorporated herein by
this reference.
2.All conditions of the staff recommendation for
this PRO/plat are incorporated herein by this.reference
(except to the extent that the same have been rendered
obsolete by the revised site Plan or are inconsistent with
any specific condition listed herein).
3.At the time of recording the final Plat of Crystal
Terrace,the open space area designated therein as Tract A
shall be dedicated to the city of Marysville for City park
purposes.
4.The revised Preliminary site Plan submitted by the
Owner,and filed under city File No.PA 8904017,is hereby
adopted pursuant to section 19.48.060(a)of the Marysville
Municipal Code.
5.The Owner shall fully comply with TIP 89-2 (to be
adopted).
6.The owner shall participate on a proportionate
share basis in the construction costs of Regional Storm
Water Detention Ponds No.Hand H-1.If such Regional
Detention Ponds are within the jurisdiction of Chapter 14.18
of the Marysville Municipal Code,the Owner shall pay a
storm drainage assessment of $425 per dwelling unit.until
the Regional Detention Ponds are completed,the owner shall
provide temporary on-site detention.This may be later
replaced with oil separator facilities and grass-lined bio-
filter swales.
7.The Owner shall participate on a proportionate
share basis in the construction costs of road improvements
along the east side of 67th Avenue N.W.which front on the
exception areas noted in Exhibit A attached hereto.
Construction of said improvements shall comply with the
schedule established by the Department of Public Works.The
Owner shall be entitled to a lien for latecomer contri-
butions for said construction costs against the properties
fronting on the exception areas.Interest shall accrue at
10%per annum.
8.Prior to the issuance of building permits for the
SUbject property the Owner shall construct full street
improvements to the centerline of 67th Avenue N.E.along the
plat's full abutting frontage.
9.No driveway access from any lots shall be allowed
onto 67th Avenue N.E.

10.On-street parking shall be prohibited on 58th
street N.E.in front of Lots 1 and 35.
11.A landscaping plan and Binding site Plan must be
approved by the city staff in conformance with section
19.48.060(b)of the Marysville Municipal Code.All develop-
ment shall be consistent with said approved plans.
section 3.The Official Zoning Map of the City of Marys-
ville as adopted in 1972 in section 5.02 of Ordinance No.772 is
hereby amended to reflect the zoning classification of the above-
described property.
