ORDINANCE NO.J 7~
AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
ROBERTSON PROPERTY AND AMENDING THE OFFICIAL ZONING MAP
PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
WHEREAS,Gene Robertson (hereinafter referred to as "Owner")
owns .255 acres of property located on the south side of 73rd
Street N.E.,350 feet west of 47th Avenue N.E.,said property
being legally described as follows:
That portion of the southeast quarter of the northwest
quarter of the northeast quarter of section 28,
Township 30 North,Range 5 East,W.M.,defined as
follows:
Beginning at the northwest corner of said
section,thence south 0'44'15"west along the
west line of said sUbdivision 132 feet,
thence north 89'32'20"east along the north
line of said sUbdivision 657.75 feet,more or
less,to the east line of said subdivision;
situate in the County of Snohomish,State of
Washington.
WHEREAS,the owner filed a petition with the city seeking to
rezone said property from the Single-Family Residential 7200
classification to the Medium-Density MUltiple-Family Residential
classification under File No.PA 8907039;and
WHEREAS,the city Planning Commission held a pUblic hearing
on said rezone application on August 8,1989 and adopted formal
findings of fact and a recommendation that said rezone appli-
cation be granted;and
WHEREAS,the City Council held a public meeting on said
rezone application on August 28,1989 and concurred with the
findings of fact and recommendation of the Planning Commission;
NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved and the above~described property is hereby
rezoned from the Single-Family Residential 7200 classification to
the Medium-Density MUltiple-Family Residential classification.

section 2.The official Zoning Map of the City of
Marysville as adopted in 1972 in section 5.02 of Ordinance
No.772 is hereby amended to reflect the reclassification of the
above-described property.
section 3.This rezone is sUbject to,and conditioned upon,
strict compliance with the following requirements:
1.site Plan Restricting Development.A site
plan/landscaping plan has been approved by the City as part
of the rezone,and said plan is incorporated herein by this
reference.Copies of the same may be obtained from the
files of the Compliance Officer,City Hall,Marysville,514
Delta Avenue,Marysville,Washington,98270.All develop-
ment of the property shall be in strict conformance with
said plan,and this restriction shall constitute a covenant
running with the land and shall be binding upon the Owner,
its successors and assigns.The plan may be modified or
amended,upon application of the Owner,by administrative
action of the City Compliance Officer;PROVIDED,that this
authority shall be limited to amendments of a minor nature
which cause no increase in intensity of use,and which do
not reduce performance standards or increase the detrimental
impact of the zone on adjoining properties.Requests for
substantial modification to the plan shall be submitted to
the Planning Commission and city Council for rehearing as a
new rezone application.
2.Frontage Improvements.Frontage improvements
along 73rd Street N.E.,including curb,gutter,sidewalk
and asphalt paving to the existing roadway,shall be
completed to the satisfaction of the city prior to the
issuance of a certificate of Occupancy for any structures on
the property.
3.Storm Water Detention.The Owner shall construct
an on-site storm water detention system with a 2-,5-,and
10-year release rate design,sUbject to approval by the city
Engineer,prior to the issuance of a certificate of
Occupancy for any structure on the property.
4.Off-site Traffic Impacts.The Owner shall fully
comply with TIP 89-2 (to be adopted).
