ORDINANCE NO./13/
AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING THE
JUBIE PROPERTY AND AMENDING THE OFFICIAL ZONING MAP
PREVIOUSLY ADOPTED IN ORDINANCE NO.772.
WHEREAS,MARK HEBERT and HARVEY JUBIE (hereinafter referred
to as "Owner")own 1.1 acres of property located on the south
side of S.R.528 approximately 200 feet west of 53rd Drive N.E.,
Marysville,Washington,said property being legally described in
Exhibit A attached hereto;and
WHEREAS,the Owner filed a petition with the City seeking to
rezone said property from the Single-Family Residential 7200
classification to the Low-Density Multiple-Family classification
under File No.PA 8905024;and
WHEREAS,the city Planning Commission held a pUblic hearing
on said rezone application on September 12,1989 and adopted
formal findings of fact and a recommendation that said rezone
application be granted;and
WHEREAS,the City Council held a pUblic meeting on said
rezone application on October 2,1989 and concurred with the
findings of fact and recommendations of the Planning Commission;
NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The findings of fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved and the above-described property is hereby
rezoned from the Single-Family Residential 7200 classification to
the Low-Density MUltiple-Family Residential classification.
section 2.The official Zoning Map of the City of
Marysville as adopted in 1972 in section 5.02 of Ordinance No.
772 is hereby amended to reflect the reclassification of the
above-described property.
section 3.This rezone is subject to and conditioned upon
strict compliance with the following requirements:
1.site Plan Restricting Development.A site
Plan/Landscaping Plan has been approved by the city as part
of the rezone,and said Plan is incorporated herein by this
reference.Copies of the same may be obtained from the
files of the Compliance Officer,City Hall,Marysville,514
Delta Avenue,Marysville,Washington,98270.All develop-

ment of the property shall be in strict conformance with
said Plan,and this restriction shall constitute a covenant
running with the land and shall be binding upon the Owner,
its successors and assigns.The Plan may be modified or
amended upon application of the Owner,by administrative
action of the City Compliance Officer;PROVIDED,that this
authority shall be limited to amendments of a minor nature
which cause no increase in intensity of use,and which do
not reduce performance standards or increase the detrimental
impact of the rezone on adjoining properties.Requests for
substantial modifications to the Plan shall be submitted to
the Planning Commission and city Council for rehearing as a
new rezone hearing application.
2.Off-site Traffic Impacts.The Owner shall fully
comply with TIP 89-2 (to be adopted).Further,the Owner
shall sign a "no protest"agreement relating to channel-
ization improvements at the S.R.528jI-5 interchange.
3.Park Mitigation Fees.The Owner shall pay the
City the sum of $200 per dwelling unit as a park mitigation
fee.Said payment shall be made prior to the issuance of a
certificate of Occupancy for each dwelling unit on the
property.
4.Miscellaneous Conditions.All additional con-
ditions imposed by the Planning Commission in its order
dated September 26,1989,except as expressly modified
herein,shall be mandatory requirements of this rezone.
