AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A
PORTION OF 6TH STREET N.E.EXTENDING BETWEEN
BURLINGTON NORTHERN RAILROAD RIGHT-OF-WAY AND CEDAR
AVENUE N.E.AND CONVEYING SAID VACATED PORTION TO THE
ABUTTING PROPERTY OWNER.
WHEREAS,by Resolution 1402 adopted on January 2,1990 the
Marysville City Council stated its intention to vacate an
unopened portion of 6th Street N.E.lying between Burlington
Northern Railroad right-of-way and Cedar Avenue N.E.,the legal
description of the same being attached hereto as Exhibit A;and
WHEREAS,a pUblic hearing was held on said vacation on
February 26,1990;and
WHEREAS,the City Council considered the evidence presented
at said hearing and entered the following findings of fact:
1.The above-described portion of 6th Street S.E.has
been abandoned as a usable public road since Sent,/Q?5C when
the railroad crossing at 6th Street N.E.was blocked off.
2.The vacation of said portion of 6th Street would
not adversely affect the street pattern or circulation of
the immediate area or the community as a whole.
3.The pUblic need will not be adversely affected by
the vacation of said portion of 6th Street.
4.No abutting owner will become landlocked nor will
access to any abutting properties be sUbstantially impaired.
5.Weiser Cedar Sales,Inc.is the owner of all
abutting property to the north and south.
6.The appraised value of the property included
within the vacated portion of 6th Street is $~!q.3'f,.;I~
Weiser Cedar Sales,Inc.shall be required to~y the city
50%of said appraised value pursuant to RCW 35.79.030.
BASED UPON THE FOREGOING FINDINGS OF FACT, THE CITY COUNCIL
OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS:
section 1.The above-described portion of 6th Street N.E.
is hereby vacated and title to the same is hereby vested in
Weiser Cedar Sales,Inc.,its successors and assigns.

section 2.In consideration for the vacation of said right-
of-way,Weiser Cedar Sales,Inc.shall immediately pay the city
of Marysville the sum of $11.4 &,q •1,1 •;
section 3.This ordinance and the vacation of the above-
described portion of 6th Street N.E.shall become effective five
days after the pUblication of this ordinance and the recording of
a certified copy of the same in the records of the Snohomish
County Auditor.Said publication and recording shall constitute
notice that the city has received payment in full pursuant to
section 2 above.

weiser Vacation of 6th Street right-of-way:
That portion of the southwest quarter of Section 28,Township 30 North,
Range 5 East,W.M.in Snohomish County,Washington,described as fol-
lows:Beginning at a point at the northwest corner of Lot 9,Block 6
of SW Sisco's Addition to Marysville according to the plat thereof as
recorded in Volume 2 on page 37,Records of Snohomish County,Washing-
ton,thence North 75 feet to the north line of 6th Street,the south-
west corner of Lot 8,Block 1 of the corrected plat of SW Sisco's Addi-
tion to Marysville,as recorded in Volume 6 on page 37,Records of
Snohomish County,Washington,thence East 94.99 feet to the west line
of the Burlington Northern Railroad right-of-way,thence Southwesterly
75.5 feet,more or less,along the west line of the Burlington Northern
railroad right-of-way,thence West 85.99 feet to the true point of be-
ginning.
Said right-of-way comprising approximately 6786.75 square feet.
