ORDINANCE NO./7 q 3
AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING
PROPERTY OWNED BY PRIME STORAGE SYSTEMS,INC.AND
AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN
ORDINANCE NO.772.
WHEREAS,PRIME STORAGE SYSTEMS,INC.owns 5.7 acres of
property located northeast of the intersection of State Avenue
and 94th Place N.E.,said property being legally described in
Exhibit A attached hereto;and
WHEREAS,PRIME STORAGE SYSTEMS,INC.applied to the city for
a rezone of said property from the Single Family Residential 7200
classification to the General Commercial classification under
File No.PA 9001002;and
WHEREAS,the City Planning Commission held public hearings
on said rezone application on May 22,1990 and June 12,1990 and
adopted Findings of Fact and a recommendation that said rezone be
granted sUbject to a Concomitant Rezone Agreement;and
WHEREAS,the City Council had a public meeting on said
rezone application on July 9,1990 and concurred with the
Findings of Fact and recommendation of the Planning Commission,
sUbject to minor modifications;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.The Findings of Fact of the Planning Commission
with respect to the above-referenced rezone application are
hereby approved,subject to minor modifications reflected in the
Concomitant Rezone Agreement,and the above-described property is
hereby rezoned from the Single Family Residential classification
to the General Commercial classification.
section 2.The zoning classification for the above-des-
cribed property shall be perpetually conditioned upon strict
compliance with the terms of a Concomitant Rezone Agreement dated
July (q ,1990 and recorded in the records of the Snohomish
County Auditor.Violation of any of the terms of said agreement
may result in reversion of the property to the single Family
Zoning classification and/or may result in enforcement action
being brought by the City.

section 3.The official zoning map of the City of Marys-
ville as adopted in 1972 in section 5.02 of Ordinance No.772 is
hereby amended to reflect the reclassification of the above-
described property.
