Home My WebLink AboutO-1806 - Annexation (Special)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO.I 'i?0 (p AN ORDINANCE OF THE CITY OF MARYSVILLE ANNEXING THAT CERTAIN UNINCORPORATED AREA KNOWN AS THE GRIFFORE PROPERTY INTO THE CITY OF MARYSVILLE. WHEREAS,on November 6,1989 the City of Marysville received a petition for annexation of certain property known as the "Griffore Property"located east of Sunnyside Boulevard and south of 56th Street N.E.,said property consisting of approximately 170 acres;and WHEREAS,a duly-advertised pUblic hearing was held on said petition before the Marysville City Council on November 27,1989 and said Council unanimously passed Resolution 1394 stating the City's intention to annex the property upon receipt of a favor- able report from the Snohomish County Boundary Review Board;and WHEREAS,on April 19,1990 the Snohomish County Boundary Review Board held a dUly-advertised pUblic hearing on said annexation and determined,pursuant to RCW 36.93.150(2),that the boundaries of the same should be increased to include an addi- tional 165 acres.On May 29,1990 the Snohomish County Boundary Review Board entered an order approving the annexation with enlarged boundaries,a legal description of the same being attached hereto as Exhibit A;and WHEREAS,pursuant to RCW 36.93.155 the city of Marysville must either pass an ordinance accepting the annexation with the enlarged boundaries,or reject the annexation as a Whole;and WHEREAS,on November 5,1990 the Marysville city Council held a duly-advertised public hearing on the annexation,with enlarged boundaries,and considered a SEPA review of the same together with testimony of affected persons and property owners, and found said annexation to be in the public interest;NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: section 1.That certain property described in Exhibit A attached hereto,being situated in the unincorporated area of Snohomish County,State of Washington,and being contiguous, ORDINANCE - 1 ,,'. proximate and adjacent to the present corporate limits of the City of Marysville,is hereby annexed to and incorporated into the City of Marysville. section 2.That certain property described in Exhibit A attached hereto shall hereafter be assessed and taxed at the same rate and on the same basis as other property within the City of Marysville,including assessments or taxes for the payment of its pro rata share of all of the outstanding indebtedness of the City contracted or incurred prior to or existing on the effective date of this ordinance. section 3.A comprehensive plan designating the above- described property in the following designations is hereby adopted for said property: Single-Family Residential 12,500 for the southeast portion of the annexation territory which is located south of 52nd street N.E.and east of 67th Avenue N.E. Low Density MUltiple Family Residential for the Glenwood Mobile Estates property. Neighborhood Commercial for tax lot #273005-4-012-0006. Single-Family Residential 9600 for the balance of the annexation territory. section 4.The preliminary plats of Eastwood Hills, Sunnyside East and Mills Addition have been approved by Snohomish County and are within the annexation territory.The City agrees to honor said plats subject to the same conditions imposed by the Snohomish County Hearing Examine and SUbject to the following additional conditions: a.The plats shall be required to comply with TIP 89-2 and TIP 89-3. b. each be ment to At the time of recording the final plats they shall required to fulfill their pre-existing voluntary agree- pay the city a Park Mitigation Fee of $200 per lot. c.At the time of recording the final plats they shall each be required to fulfill their pre-existing voluntary agree- ment to pay the Allen Creek Diking District a mitigation fee of $125 per lot. d.Recording of the final plats shall be processed through the city of Marysville,including payment of final plat fees, inspection fees and submittal of performance bonds and guaranty bonds.
