AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING
ORDINANCE NO.1795,EXTENDING THE DURATION THEREOF.
RECITALS
1.On February 26,1990 the city enacted Ordinance 1763,
and on August 13,1990 the city enacted Ordinance 1795.Both of
said ordinances imposed temporary restrictions on new sewer
connections'to the city's sewer system in response to an emer-
gency condition relating to the capacity and functional perfor-
mance of the City's wastewater treatment facility.All recitals
contained in Ordinances 1763 and 1795 are incorporated herein by
this reference.
2.section 10 of Ordinance 1795 provides that it shall
automatically terminate,and be of no further force and effect,
on February 11,1991 unless extended by action of the City
Council.
3.The city's preliminary efforts toward upgrading its
sewer system,and its efforts toward bringing customers into
compliance with discharge limitations,has resulted in a marked
improvement in the performance of its wastewater treatment
facility.For the months of November and December,1990 the city
was in full compliance with all criteria established in the
Washington State Department of Ecology Consent Order under File
No.DE 89-N259.However,said compliance was marginal,and the
monitoring of the performance of the wastewater treatment plant
during the month of January,1991 indicates that the city is no
longer in compliance and is above the maximum hydraulic loading
limit of 2.8 million gallons per day.
4.Because there is an insufficient history of consistent
full compliance with the Consent Order,the City Council finds
that it is in the public interest and in the interest of environ-
mental protection to continue the temporary restrictions on new
sewer connections to the city's sewer system.It is also
necessary to continue to have a mechanism in place,in advance,
to totally ban new connections in the event that the criteria set
forth in the Consent Order are violated.
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON DO ORDAIN AS FOLLOWS:
ORDINANCE
section 1.section 10 of Ordinance 1795 is hereby amended
to read as follows:
section 10.Duration.This ordinance shall
automatically terminate,and be of no further

following pUblic notice and hearing.
section 2.Effective Date.This is a pUblic emergency
ordinance necessary for the protection of pUblic health.The
effective date of this ordinance shall be February 11,1991.
PASSED by the City council and APPROVED by the Mayor this
