ORDINANCE NO ./&"'.33.
AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING SECTION
5 OF ORDINANCE 1795 RELATING TO SEPA POLICY.
WHEREAS,under section 5.1 of Ordinance 1795 the City
declared that any new development activity which would result in
increased wastewater discharges into the City's sewer system,or
increasing the BOD loading in said system,will create a sig-
nificant adverse environmental impact;and
WHEREAS,section 5.2 of Ordinance ~795 prohibits any
hearings,approvals or permits for any development activity
without prior SEPA review relating to the impacts on the City's
sewer system;and
WHEREAS,under section 5.2 of Ordinance 1795 if the City's
Responsible Official determines that a project has not proposed
adequate mitigation relating to sewer system impacts,a Deter-
mination of significance shall issue and the project shall not be
allowed to proceed until after an EIS is prepared;and
WHEREAS,the city has completed an environmental impact
statement relating to the ultimate upgrade of its wastewater
treatment facility and has now prepared detailed engineering
plans and specifications for said upgrade;and
WHEREAS,property owners who are SUbject to a determination
of significance may now use the EIS prepared by the city in lieu
of preparing their own;
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON DO ORDAIN AS FOLLOWS:
section 5 of Ordinance 1795 as adopted on August 13,1990 is
hereby amended to read as follows:
section 5.SEPA Policy.
5.1 This ordinance is hereby adopted as
a SEPA policy of the city of Marysville.For
the duration of this ordinance the city
declares that any new development activity
which will result in increasing wastewater
discharges into the city's sewer system,or

increasing the BOD loading in said system,
will create a significant adverse environmen-
tal impact.
5.2 No hearings,approvals or permits
shall be allowed for any development activity
without prior SEPA review relating to the
impacts on the City's sewer system.If
adequate mitigation for such impacts is
proposed for a particular project,as
determined by the City's Responsible Offi-
cial,an MONS may be issued and the project
may be allowed to proceed.
Because the city has prepared an EIS on
the sewer system itself,all projects for
which a Determination of Significance is or
has been issued may use the EIS prepared by
the City.PROVIDED,the use of the city's
EIS shall not prohibit the Responsible
Official from requiring,when necessary and
appropriate,a supplement and/or addendum to
the EIS where the impacts of specific
development activity are not adequately
addressed in the city's EIS.PROVIDED,
further,this section shall not be construed
as limiting in any way the City's right to
require appropriate mitigation of any sewer
system impacts resulting from a particular
project.
5.3 The term "development activity,"as
used in this ordinance,shall include,but
shall not be limited to,sUbdivisions,short
sUbdivisions,project rezones,binding site
plans,conditional use permits,shoreline
permits,plan checks and approvals,building
permits,sewer connection applications,sewer
utility commitment letters,ULIDs,sewer
extensions,and annexations of areas outside
of RUSA.
Except as specifically provided herein,Ordinance 1795 and
any amendments thereto shall remain in full force and effect,
unchanged.
