HomeMy WebLinkAboutO-1834 - Amends Sec. 20.16.200, preliminary plat (Not codified)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE No./Q3ef AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING MMC SECTION 20.16.200 RELATING TO EXPIRATION OF APPROVAL OF PRELIMINARY PLATS. WHEREAS,RCW 58.17.140 and MMC 20.16.200 require all preliminary plats to be submitted for final plat approval within three years of the date of preliminary plat approval unless a written request is made at least 30 days before the expiration of said three-year period;and WHEREAS,RCW 58.17.140 authorizes the City to allow other extensions of time for finalizing preliminary plats and allow such extensions to be granted on the condition that additional or altered requirements are met by the applicant;and WHEREAS,the City Council of the city of Marysville finds that where exceptional circumstances exist that would create an undue hardship for the applicant by its failure or inability to apply for an extension of time prior to the expiration of the three-year preliminary plat period,an exception to the 30-day prior written request requirement should be granted upon a showing of good cause; NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: MMC section 20.16.200 is hereby amended to read as follows: 20.16.200 Expiration of approval of preliminary plat.A final plat meeting all requirements of this chapter and RCW Chapter 58.17,shall be submitted to the City for approval within three years of the date of preliminary plat approval;PROVIDED,that an applicant who files a written request with the city Council at least thirty days before the expiration of this three-year period shall be granted a one 1-year extension upon a showing that the applicant has attempted in good faith to submit the final plat within the three-year period.PROVIDED, FURTHER,an applicant who fails to file a written request with the city Council within 30 days before the expiration of the three-year period may, upon a showing of good cause,file a written request with the City Council within six ORDINANCE months of the expiration of the three-year period requesting a one-year extension upon a showing of good cause why the written extension request was not made within 30 days of the preliminary plat expiration.In such cases where the applicant has failed to file a written request at least 30 days before the expiration of the three-year period,the city council may,without further hearing,impose such additional or altered conditions and requirements on the prelimi- nary plat which are consistent with any changed conditions or new information over the pendency of the preliminary plat and/or which reflect any changes in city policy or ordinance which have been adopted since the preliminary plat approval.
