AN ORDINANCE OF THE CITY OF MARYSVILLE RELATING TO AND
PROVIDING FOR THE CONDEMNATION OF NECESSARY RIGHT-OF-
WAY FOR THE CONSTRUCTION AND WIDENING OF GROVE STREET
IN THE CITY OF MARYSVILLE AND DECLARING THE ACQUISITION
OF SAID RIGHT-OF-WAY TO BE IN THE PUBLIC INTEREST.
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
WHEREAS,pursuant to RCW 8.12.030,the City of Marysville is
authorized and empowered to acquire real property by eminent
domain for the construction and operation of pUblic streets;and
WHEREAS,the City has determined that it is in the public
interest and necessary to improve and widen Grove Street between
47th Street N.E.and 51st Street N.E.in the City of Marysville;
and
WHEREAS,the city's consulting engineer has designed a
right-of-way alignment for the improvement and widening of Grove
Street that would necessitate the acquisition of right-of-way
between 47th Street N.E.and 51st Street N.E.adjacent to Grove
Street in the city of Marysville;and
WHEREAS,one parcel of real property needed for the
aforementioned widening of Grove Street is owned by ORLO K.
WILLIAMS and GLORIA WILLIAMS,husband and wife,and/or WORLD
SAVINGS AND LOAN ASSOCIATION,a federal savings and loan asso-
ciation,the legal description of said property being attached
hereto as EXHIBIT A;and
WHEREAS,said owners and the city have been unable to agree
upon the terms of,and compensation for,certain right-of-way
lying adjacent to Grove Street described in EXHIBIT B,which is
attached hereto;
NOW,THEREFORE,the City Council of the Marysville,Washing-
ton do ordain as follows:
1.The city hereby declares the acquisition of 1,561.45
square feet of right-of-way,the legal description of which is
attached hereto as EXHIBIT B,to be necessary for the construc-
tion,widening and improvement of Grove Street as described above
and to be necessary and in the pUblic interest.

2.The city hereby authorizes commencement of condemnation
proceedings against the owners of said property described in
EXHIBIT A,for the acquisition of the required right-of-way
described in EXHIBIT B.
3.The city hereby authorizes immediate payment to said
owners of just compensation for said right-of-way in considera-
tion for the right to immediate possession and use of the subject
property for the purpose of constructing,widening and improving
Grove street.
PASSED by the city council and APPROVED by the Mayor this

The west 159.42 feet of the north 196 feet of the
northwest quarter of the northwest quarter of the
southeast quarter of the northeast quarter of Section
28,Township 30 North,Range 5 East,W.M.,in Snohomish
County,Washington;
EXCEPT the north 20 feet and the west 30 feet thereof
for road.

Description of Property to be Condemned
That portion of the following-described parcel lying within the
north 30 feet of the southeast quarter of the northeast quarter
of section 28,Township 30 North,Range 5 East,W.M.
The west 159.42 feet of the north 196 feet of the
northwest quarter of the northwest quarter of the
southeast quarter of the northeast quarter of section
28,Township 30 North,Range 5 East,W.M.,in Snohomish
county,Washington;
EXCEPT the north 20 feet and the west 30 feet thereof
for road;
TOGETHER WITH that portion of the southeast quarter of the
northeast quarter of said section 28 lying between lines which
are parallel with and 30 feet south of and east of the north and
west lines,respectively,of said southeast quarter of the
northeast quarter and lying northwesterly of a curve concave to
the southeast having a radius of 35 feet,which curve is tangent
to said parallel lines.
Containing 1561.45 square feet.
