HomeMy WebLinkAboutO-1873 - Rezone (Special)CIT Y 0 F MAR Y S V ILL E Marysville,Washington ORDINANCE NO./~73> AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING PROPERTY OWNED BY PRIME STORAGE SYSTEMS,INC.AND AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772. WHEREAS,Prime Storage Systems,Inc.owns 1.34 acres of property located north of 100th Street N.E.,east of the intersection of Shoultes Road and 100th street,said property being legally described in EXHIBIT A attached hereto;and WHEREAS,Prime Storage Systems,Inc.applied to the city for a rezone and Comprehensive Plan modification of said property from RS-7200 to RMH (Multiple Residential,High Density)and Comprehensive Plan modification from Low Urban Residential to Medium-High Density MUltiple-Family under File No.PA 9001001; and WHEREAS,the City Hearing Examiner held a public hearing on said rezone and Comprehensive Plan application on October 24, 1991 and adopted findings of fact and a recommendation approving a Comprehensive Plan modification to Medium Density Multiple- Family and a rezone to Residential Multi-Family,Medium Density sUbject to 10 conditions;and WHEREAS,the Marysville city Council had a pUblic meeting on said rezone and Comprehensive Plan application on January 13, 1992 and concurred with the findings of fact and recommendation of the Hearing Examiner,sUbject to modifications which were based upon the record before the Hearing Examiner;NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.The findings of fact of the Hearing Examiner with respect to the above-referenced rezone and Comprehensive Plan amendment are hereby approved,sUbject to the modification that the City staff recommendations for payment of mitigation fees for the Parks Department of $100 per unit and mitigation fees to Marysville School District of $650 per unit be incorporated as conditions of the said approval. section 2.The above-described property is hereby rezoned from RS-7200 to Residential MUlti-Family,Medium Density,and the Comprehensive Plan designation is hereby amended from Low Urban Residential to Medium Density Multiple-Family. Ordinance - 1 section 3.The official zoning map of the City of Marysville as adopted in 1982 in section 5.03 of Ordinance 772 is hereby amended to reflect the reclassification of the above- described property,and the Comprehensive Plan of the city of Marysville is hereby amended as recommended by the Hearing Examiner. section 4.The rezone and Comprehensive Plan amendment for the above-described property shall be strictly conditioned upon compliance with each and every condition set forth in the Hearing Examiner's decision and as modified by the City council.
