AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING PROPERTY
OWNED BY THE HOUSING AUTHORITY OF SNOHOMISH COUNTY AND
AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN
ORDINANCE NO.772.
WHEREAS,the Housing Authority of snohomish County owns 6.13
acres located on the north side of 84th Street N.E.at the 7400
block,said property being legally described in Exhibit A
attached hereto;and
WHEREAS,the Housing Authority of Snohomish County applied
to the City for a rezone from Single Family (RS-9600)to
Residential MUltiple Family,Low Density under File
No. PA 9112051;and
WHEREAS,the city Hearing Examiner held a pUblic hearing on
said rezone on March 12,1992 and adopted Findings of Fact,
Conclusions and a Recommendation approving the rezone SUbject to
fifteen (15)conditions;and
WHEREAS,the City Council held a pUblic meeting on said
rezone on April 13,1992 and concurred with the Findings of Fact,
Conclusions and Recommendation of the Hearing Examiner,with
modifications as set forth below;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
section 1.Except as provided in section 2 herein,the
Findings of Fact,Conclusions and Recommendation of the Hearing
Examiner with respect to the above-referenced rezone are hereby
approved,and the above-described property is hereby rezoned from
single Family (RS-9600)to Residential Multiple Family,Low
Density.
section 2.Condition No.9 of the Hearing Examiner
referencing Ordinance 1846 is hereby revised to reference
Ordinance 1883.A Condition No. 16 shall be added to the Hearing
Examiner's conditions which shall read as follows:"16.The
Applicant shall agree not to protest the formation of an LID for
improvements to 67th Avenue N.E."
section 3.The zoning classification for the above-
described property shall be perpetually conditioned upon strict
compliance with each of the conditions set forth in the
Recommendation of the Hearing Examiner as amended and

supplemented by the city council.Violation of any of the
conditions of said Recommendation may result in reversion of the
property to the previous zoning classification and/or may result
in enforcement action being brought by the City.
section 4.The official zoning map of the City of
Marysville as adopted in section 5.02 of Ordinance 772 is hereby
amended to reflect the reclassification of the above-described
property.
section 5.This decision shall be final and conclusive with
the right of appeal by any aggrieved party to the superior Court
of Snohomish County by writ of certiorari,writ of prohibition,
or writ of mandamus within fifteen (15)calendar days after the
passage of this ordinance.
