AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION
OF 75TH AVENUE N.E.IN THE PLAT OF BRIGHTON PARK IN THE
CITY OF MARYSVILLE.
WHEREAS,Harbour Homes/Geonerco,Inc.petitioned the city on
December 9,1992 to vacate a portion of 75th Avenue N.E.in the
Plat of Brighton Park;and
WHEREAS,by Resolution 1602 adopted on January 11,1993,the
Marysville city Council stated its intention to vacate a portion
of 75th Avenue N.E.lying within the Plat of Brighton Park,said
property being legally described in Exhibit A attached hereto;
and
WHEREAS,a public hearing was held on the vacation of said
street on February 1,1993;and
WHEREAS,the city Council considered the evidence presented
at the hearing and entered the following Findings of Fact:
1.The above-described portion of 75th Avenue N.E.has
remained unopened since it was originally acquired by the City,
and serves no public purpose so long as an alternate alignment
for said street is constructed by the applicant as proposed for
the Plat of Brighton Park.
2.The vacation of this portion of 75th Avenue N.E.would
not adversely affect the street pattern or circulation of the
immediate area or the community as a whole.
3.The public need will not be adversely affected by the
vacation of this street.
4.No abutting owner will become landlocked nor will
access to any abutting properties be substantially impaired.
5.The abutting owner of the vacated street is willing to
purchase said right-of-way from the city at a price of $291.52,
representing 50%of the assessed valuation of the same.
BASED UPON THE FOREGOING FINDINGS OF FACT, THE CITY COUNCIL
OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS:
section 1.The above-described portion of 75th Avenue N.E.
is hereby vacated and the City hereby conveys fee simple title to
the same to Harbour Homes/Geonerco,Inc.

section 2.In consideration for the vacation of said
street,and as a condition of pUblication and recording of this
ordinance,the abutting owner who is receiving title to the
street shall pay the City the sum of $291.52 for the property
conveyed to it.
Section 3.This ordinance and the vacation of the street
referred to herein shall become effective five (5)days after the
pUblication of this ordinance and the recording of a certified
copy of the same in the records of the Snohomish County AUditor.
PASSED by the city Council and APPROVED by the Mayor this

COMMENCING AT THE NORTHWEST CORNER OF TRACT 61,PLAT OF SUNNYSIDE
FIVE ACRE TRACTS,ACCORDING TO THE PLAT THEREOF RECORDED IN
VOLUME 7 OF PLATS,ON PAGE 19,RECORDS OF SNOHOMISH COUNTY,
WASHINGTON;THENCE NORTH 89 07'20"WEST,ALONG THE NORTHERLY
PROJECTION OF SAID TRACT 61 FOR 30.0 FEET TO THE CENTERLINE OF
75TH STREET N.E.;THENCE SOUTH 1 02'44"WEST ALONG THE SAID
CENTERLINE OF SAID 75TH STREET N.E.,FOR 224.80 FEET TO THE TRUE
