HomeMy WebLinkAboutO-1969 - Rezone (Special)CITY OF MARYSVILLE Marysville,Washington ORDINANCE No.l9fo 9 AN ORDINANCE OF THE CITY OF MARYSVILLE REZONING PROPERTY OWNED BY SALLY OKADA,AMENDING THE OFFICIAL ZONING MAP PREVIOUSLY ADOPTED IN ORDINANCE NO.772,AND APPROVING THE PRELIMINARY PLAT FOR THE SUBDIVISION OF STATE AVENUE EAST. WHEREAS,Sally Okada owns approximately 5.46 acres located east of State of Avenue,north of the intersection of 44th Drive N.E.and 94th Place N.E.in the city of Marysville,said property being legally-described in Exhibit A attached hereto;and WHEREAS,Sally Okada,Bud Darling,and William Roberts applied to the city for preliminary plat approval,and a rezone from General Commercial to RS-7200 under File No.PA 9212066;and WHEREAS,the city Hearing Examiner held a public hearing on said rezone and preliminary plat application on September 9, 1993,and adopted Finding of Fact,Conclusions,and a Recommendation approving the rezone and preliminary plat,sUbject to fifteen (15)conditions;and WHEREAS,an appeal to the decision of the Hearing Examiner was submitted by residents of Wadehaven on October 5,1993 relating to the heights of residential structures for Lots 1 through 9 in the proposed sUbdivision;and WHEREAS,the appellants and the applicant have represented to the city that their differences have been fully resolved and, as such,the appeal was withdrawn;and WHEREAS,the City Council held a pUblic hearing on said rezone and preliminary plat on October 11,1993 and concurred with the Findings of Fact,Conclusions,and Recommendation of the Hearing Examiner;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: section 1.The Findings of Fact,Conclusions and Recommendation of the Hearing Examiner with respect to the.above- referenced rezone and preliminary plat application are hereby approved,and the above-described property is hereby rezoned from General Commercial to RS-7200. ORDINANCE - 1 Imsvl/okada.ord section 2.That portion of Ordinance No.1793 as it relates to the property described in Exhibit A only is hereby repealed for the reason that it is replaced by this ordinance. section 3.The zoning classification for the above- described property shall be perpetually conditioned upon strict compliance with each of the conditions set forth in the Recommendation of the Hearing Examiner.Violation of any of the conditions of said decision may result in reversion of the property to the previous zoning classification and/or may result in enforcement action being brought by the City. section 4.The official Zoning Map of the city of Marysville as adopted in section 5.02 of Ordinance No.772 is hereby amended to reflect the reclassification of the above- described property. section 5.This decision shall be final and conclusive with the right of appeal by any aggrieved party to the Superior Court of Snohomish County by writ of certiorari,writ of Prohibition, or writ of Mandamus within fifteen (15)calendar days after the passage of this ordinance. ~PASSED by~h~city Council and APPROVED by the Mayor thisc2SdayofLJ;%~r 1993.
