HomeMy WebLinkAboutO-1981 - Adds Ch. 3.90, tribal gaming fund (3.90)J-~,~, ?_~7:>~. /-T~ CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO.jqgl AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON ENACTING A NEW CHAPTER 3.90 OF THE MARYSVILLE MUNICIPAL CODE ESTABLISHING A TRIBAL GAMING FUND AND RECOGNIZING THE SOURCES AND USES OF FUNDS DEPOSITED THEREIN. WHEREAS,pursuant to a Tribal-State Compact for Class III Gaming between the Tulalip Tribes of Washington and the State of Washington dated May 29,1992,the Tulalip Tribes of Washington have agreed to make a community contribution of the net win of the Tribes'gaming operations to be paid to the City of Marysville for law enforcement purposes to defray potential impacts upon the City that may result form the operation of the gaming facility;and WHEREAS,the City believes it to be necessary and appropriate to recognize the sources and uses of funds received from said Tribal gaming operations; NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON DO ORDAIN AS FOLLOWS: A new Chapter 3.90 of the Marysville Municipal Code is hereby enacted providing as follows: TRIBAL GAMING FUND 3.90.010 Fund Created. established a fund to be "Tribal Gaming Fund." There is created and designated the 3.90.020 Source of Funds.The Tribal Gaming Fund shall include deposits pursuant to Section 14(c)of the Tribal-Compact for Class III Gaming between the Tulalip Tribes of Washington and the State of Washington,as it now reads or is hereinafter amended.Said source of funds constitutes a percentage of the net win of the gaming stations conducted by the Tribal gaming operations. 3.90.030 Expenditures.Expenditures of the deposits made pursuant to Section 3.90.020 above shall be limited to law enforcement purposes.For the purpose of this ordinance, "law enforcement purposes"shall be defined as those activities normally related to police services and the support of police services as set forth in Section 521.00 of /wpf/rnv/gaming.ord 1 the State of Washington Budgeting,Accounting and Reporting System (BARS)relating to expenditure/use for law enforcement. 3.90.040 Unexpended Funds.Any unexpended funds remaining in the Tribal Gaming Fund at the end of the budget year shall not be transferred to the City's current expense fund or otherwise lapse;rather,said unexpended funds shall be carried forward from year to year until expended for the purposes set forth in Section 3.90.030. 3.90.050 Severability.If any section, sentence,clause or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction,such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section,sentence,clause or phrase of this ordinance.
