AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A DEDICATED RIGHT OF WAY AT THE CORNER OF 52ND N.E. AND 75TH AVENUE N.E. IN MARYSVILLE,WASHINGTON,ON APPLICATION OF FOREST PARK REALTY, INC., A WASHINGTON CORPORATION. WHEREAS,by Resolution 1699 adopted on July 25,1994,the Marysville City Council stated its intention to vacate a dedicated right of way at the corner of 52nd N.E.and 75th Avenue N.E.,and being legally described on EXHIBIT A attached hereto; and WHEREAS,a public hearing was held on the vacation of said street on August 22,1994;and WHEREAS,the City Council considered the evidence presented at the hearing and entered the following findings of fact: 1.The above-described dedicated right of way is not needed for a public street,and serves no public purpose. 2 . adversely immediate The vacation of this dedicated right-of-way would affect the street pattern or circulation of the area or the community as a whole. not 3.The public need will not be adversely affected by the vacation of this alley. 4.No abutting owner will become landlocked nor will access to any abutting properties be substantially impaired. 5.The abutting owner of the vacated right of way is willing to purchase said right-of-way from the City at a total price of $325.97,representing 50%of the assessed valuation of the same. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.That portion of 52nd N.E.and 75th Avenue N.E. as legally described in EXHIBIT A is hereby vacated. Section 2.In consideration for the vacation of said street,the abutting owner who is receiving title to the right of way shall pay the City the sum of $325.97 for the property conveyed to it.Payment of said sum shall be a condition precedent of this ordinance becoming effective.
