AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON AMENDING
CHAPTER 6.60 OF THE MARYSVILLE MUNICIPAL CODE BY ADOPTING
SPECIFICPROVISIONS OFTITLES 9.41 RCW AND 77 .16 RCW BY REFERENCE,
AMENDING SECTION 6.60.040 RELATINGTO CONFISCATION OF FIREARMS,
ADDING A NEW SECTION 6.60.050 RELATING TO DISPOSITION OF
FIREARMS.
WHEREAS,certain provisions of Titles 9.41 RCW and 77.16 RCW
which were adopted by reference in the Marysville Municipal Code
have been repealed or revised by the legislature;and
WHEREAS,the Marysville Police Department obtains possession
of firearms that are judicially forfeited and no longer needed
for evidence,or forfeited due to a failure to make a claim;and
WHEREAS,pursuant to RCW 9.41.098,the Marysville City
Council is authorized to adopt policy concerning the disposition
of forfeited firearms;and
WHEREAS,the Marysville City Council deems it to be in the
interest of the public health,safety and welfare to adopt a
clear policy concerning disposition of forfeited firearms;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Marysville Municipal Code Section 6.60.010 is
hereby amended to read as follows:

Section 2.Marysville Municipal Code Section 6.60.040,is
hereby amended to read as follows:
6.60.040 Confiscation.The Chief of Police and his or
her designees shall confiscate any and all firearms or
other weapons found to be in the possession of a person
under the circumstances contained in RCW 9.41.098 as
now or hereafter amended.After confiscation,the
firearm or other weapon shall not be surrendered
except:(a)to the prosecuting attorney for use in
subsequent legal proceedings,(b)for disposition
according to an order of a court of competent
jurisdiction,(c)to the owner in compliance with the
provisions of RCW 9.41.098 as now or hereafter amended,
or (d)as otherwise authorized by this chapter.
Section 3.A new section is hereby added to Chapter 6.60 of
the Marysville Municipal Code,which shall read as follows:
6.60.050 Disposition of Firearms.All firearms taken
into the custody of the Marysville Police Department on
or after July 1,1993,and that are judicially
forfeited or forfeited due to a failure to make a claim
under RCW 63.40.010,are to be disposed of as follows:
(1)The Marysville Police Department may retain
legal firearms for agency use.
(2)The Chief of Police,or his designee,may
auction or trade legal firearms to properly licensed
commercial sellers,as deemed appropriate by the Chief
of Police or his designee.All proceeds of an
auction/trade may be retained by the Marysville Police
Department for agency use.

destroy legal firearms in lieu of (1)and (2)above at
the discretion of the Chief of Police.
(4)Firearms determined by the Chief of Police or
his designee to be illegal for any person to possess
shall be destroyed.
(5)No firearm shall be disposed of while it is
needed for evidence.
Section 4.If any provision of this ordinance or its
application to any person or circumstance is held invalid,the
remainder of the ordinance or the application of the provision to
other persons or circumstances is not affected.
