AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON ADOPTING A
GROWTH MANAGEMENT COMPREHENSIVE PLAN FOR THE CITY OF
MARYSVILLE AND SUPERSEDING EXISTING POLICIES CONTAINED IN THE
1978 COMPREHENSIVE PLAN AND THE INTERIM COMPREHENSIVE PLAN
ADOPTED IN 1994 AND REPEALING RESOLUTION NOS.909 AND 1702.
WHEREAS,the State Legislature enacted the Growth Management
Act in 1990 requiring cities and counties throughout the state to
adopt comprehensive plans for a twenty-year planning period that
includes elements addressing land use,housing,transportation,
capital facilities,and utilities;and
WHEREAS,Marysville commenced an update to its 1978
Comprehensive Plan in 1988.The Growth Management Act ("GMA")
was passed in 1990 and required that Marysville adopt a
comprehensive plan with certain required and optional elements;
and
WHEREAS,the City has elected to include Economic
Development,Parks and Recreation,and Environmental and Resource
Management as important elements in the comprehensive plan which
are not mandated by the Growth Management Act;and
WHEREAS,the Planning Commission has been meeting since 1988
to determine the growth needs and wishes of the community for
Marysville's future and since 1990 to develop a comprehensive
plan consistent with the requirements of the GMA;and
WHEREAS,the City has conducted an extensive public outreach
program in the development of the Growth Management Comprehensive
Plan and the Planning Commission and City Council have conducted
numerous public workshops and hearings to obtain public input
regarding growth issues related to Marysville's future;and
WHEREAS,the cit~eens,business community,property owners,
neighborhoods and civic organizations have expressed as desirable
qualities for Marysville's planning guidelines the ideals of
protecting neighborhood character,encouraging economic
diversity,prowoting affordable housing,concentrating jobs in
Marysville,increasing residential densities while maintaining a
sense of community,providing adequate levels for public
services,and maintaining a high quality of life;and
WHEREAS,pursuant to Resolution No.1702,the Marysville
City Council adopted an interim land use element which has
provided for the orderly accommodation of growth in Marysville
until the attached final Comprehensive Plan containing all
elements required under the ~MA has been developed;and

WHEREAS,Snohomish County has designated the Urban Growth
boundaries for Marysville and the greater Marysville area as
required by the GMA;and
WHEREAS,the Planning Commission and City Council considered
three (3)alternative growth scenarios as possible choices for
Marysville's future and has reviewed the environmental impacts
and policy tradeoffs of the alternatives pursuant to the State
Environmental Policy Act (SEPA),including a scoping process,
Draft Environmental Impact Statement,Final Environmental Impact
Statement,and addendum thereto;and
WHEREAS,the Planning Commission has recommended to the City
Council a growth concept for the Preferred Alternative
comprehensive plan that most closely represents the desires of
the Marysville community for the City's future growth pattern;
and
WHEREAS,the City Council has conducted public workshops and
public hearings to review the recommendations of the Planning
Commission and to take additional public testimony;and
WHEREAS,the City Council finds that the policies,land use
designations,and investment strategies of the Preferred
Alternative comply with the requirements of the Growth Management
Act and are consistent with the County-side Planning Policies;
and
WHEREAS,the City Council finds that the Preferred
Alternative for the Growth Management Comprehensive Plan provides
for the orderly accommodation of growth in Marysville and
promotes the best long-term interests of the Marysville
community;and
WHEREAS,the City Council will use the Growth Management
Comprehensive Plan as a guide in the development of specific work
programs and functional plans,amendment of development
regulations,design of improvement projects,and preparation of
budgets that implement the community's vision for the future as
expressed in the Growth Management Comprehensive Plan;and
WHEREAS,the City will hold additional public hearings to
consider public testimony regarding rezone proposals necessary to
make the Zoning Map consistent with the Land Use Map of the
Growth Management Comprehensive Plan,and that through this
public decision-making process future refinements to the Land Use
Map may be made as deemed appropriate;and
WHEREAS,the City will amend the various development
regulations of the City as necessary to implement the policies
and land use designations of the Growth Management Comprehensive
Plan;and
WHEREAS,the City will monitor the growth occurring under
the Growth Management Comprehensive Plan and will periodically

review and update the plan as provided by the Growth Management
Act to make adjustments as needed to respond to changing
circumstances and to ensure that growth in the community is of a
desirable character and occurs in an orderly manner;and
WHEREAS,while target population growth forecasts have been
established for the Marysville Planning Area,the target must be
reevaluated periodically.Since the population growth assumed in
its target may be affected by many factors over which the City
has little influence,the City must review and adjust the target
if planning strategies do not produce the housing needed to
accommodate the population growth target;and
WHEREAS,the City Council recognizes that the population
projected within the Preferred Alternative within the current
Marysville city limits and the Marysville Planning Area are
target population numbers;that planning under the Growth
Management Act is an iterative process,and as additional
information becomes available and additional decisions are made,
subsequent adjustments to the plan and the population targets
will need to be made;
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.That the City Council hereby adopts in
accordance with the State of Washington Growth Management Act the
Comprehensive Land Use Plan entitled "Proposed Comprehensive Plan
City of Marysville"dated April 1,1996 as last amended by the
City Council at its February 20,1996 meeting,a copy of which is
attached hereto and incorporated herein by reference and which
shall be filed in the office of the City Clerk for public
inspection.
Section 2.That the body of policies adopted over time that
are contained in the 1978 Comprehensive Plan and 1994 Interim
Comprehensive Plan are hereby superseded and replaced by those
contained in the attached Growth Management Comprehensive Plan.
Accordingly,Resolution No.909 adopting the 1978 Comprehensive
Plan and Resolution No.1702 adopting the 1994 Interim
Comprehensive Plan are hereby repealed.
Section 3.That specific programs,functional plans,codes
and standards which implement the growth concepts of the attached
Growth Management Comprehensive Plan will be adopted or updated
as needed without having to be incorporated into the annual
amendment process for the Comprehensive Plan as limited by the
Growth Management Act.
Section 4.That to implement the policies and directives of
the Comprehensive Plan hereby adopted,the City Council must
revise the City's Zoning Map.In order to do this,the Council
shall have the discretion to make changes to the Zoning Code and
Zoning Map.

Section 5.That in addition to the authority provided by
Chapter 36.70A RCW,the City adopts the comprehensive plan
attached hereto under its general land use authority,Washington
State Constitution,Article XI,Section 11,and Chapter 35.63
RCW.
Section 6.That should any section,subsection,paragraph,
sentence,clause or phrase set forth in this ordinance or in the
Comprehensive Plan attached hereto,or its application to any
person or situation be declared unconstitutional or invalid for
any reason,such decision shall not affect the validity of the
remaining portions of this ordinance,the Comprehensive Plan,or
its application to any other person or situation.The City
Council of the City of Marysville hereby declares that it would
have adopted this ordinance and the Comprehensive Plan and each
section,subsection,sentence,clause,phrase or portion thereof
irrespective of the fact that anyone or more sections,
subsections,sentences,clauses,phrases or portions be declared
invalid or unconstitutional.
Section 7.It is expressly the purpose of this ordinance to
provide for and promote the health,safety and welfare of the
general public and not to create or otherwise establish or
designate any particular class or group of persons who will or
should be especially protected or benefited by the terms of this
ordinance.
It is the specific intent of this ordinance that no
provisions nor any term used in this ordinance is intended to
impose any duty whatsoever upon the City or any of its officers
or employees.
Nothing contained in this ordinance is intended nor shall be
construed to create or form the basis of any liability on the
part of the City,or its officer,employees or agents,for any
injury or damage resulting from any action or inaction on the
part of the City,its officers,employees or agents.
