AN ORDINANCE OF THE CITY OF MARYSVILLE GRANTING A CONDITIONAL
USE PERMIT AND REZONE FOR PROPERTYOWNED BY DENNY HARWOOD
AND GARY WILLETT, AND AMENDING THE OFFICIAL ZONING MAP
PREVIOUSLY ADOPTED IN ORDINANCE NO.772,SUBJECTTO CONDITIONS.
WHEREAS,Denny Harwood and Guy Willett own certain real
property located on the west side of 73rd Avenue,south of 56th
Street,east of 71st Avenue and north of 52nd Street in the City of
Marysville,being legally described in Exhibit A attached hereto;
and
WHEREAS,the applicants applied to the City for a Conditional
Use Permit to allow construction of two duplexes on proposed Lots
3 and 5,and a rezone from RS-12,500 to RS-9600 under File No.
PA 94030112 to allow a six-lot short subdivision on approximately
1.4 acres;and
WHEREAS,the City Hearing Examiner held a public hearing on
March 14,1996 and adopted Findings of Fact,Conclusions and a
Recommendation approving the Conditional Use Permit and rezone
subject to fourteen (14)conditions;and
WHEREAS,the City Council held a public meeting on said
Conditional Use Permit and rezone on April 22,1996 and concurred
with the Findings of Fact,Conclusions and Recommendation of the
Hearing Examiner;NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO
ORDAIN AS FOLLOWS:
1.The Findings of Fact,Conclusions and Recommendation of
the Hearing Examiner with respect to the above-referenced
Conditional Use Permit under File No.PA 94030112 is hereby
approved,and the above-described property is hereby rezoned from
RS-12,500 to RS-9600.
2.The Conditional Use Permit and rezone for the above-
described property shall be perpetually conditioned upon strict
compliance with each of the conditions set forth in the
Recommendation of the Hearing Examiner.Violation of any of the
conditions of said decision may result in revocation of the
Conditional Use Permit and rezone or enforcement action being
brought by the City.

in Section 5.02 of Ordinance No.772 is hereby amended
the reclassification of the above-described property.

4.This decision shall be final and conclusive with the
right of appeal by any aggrieved party to the Superior Court of
Snohomish County by filing a Land Use Petition pursuant to the
Land Use Petition Act within twenty-one (21)days after the
passage of this ordinance.
