AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF
UNOPENED 76TH PLACE N.E. (OLSON).
WHEREAS,by Resolution adopted on April 22,1996,the
Marysville City Council stated its intention to vacate a portion
of unopened 76th Place N.E.,and being legally described on
EXHIBIT A attached hereto;and
WHEREAS,a public hearing was held on the vacation of said
street on June 24,1996;and
WHEREAS,the City Council considered the evidence presented
at the hearing and entered the following findings of fact:
1.The above-described portion of 76th Place N.E.has
remained unopened since it was originally acquired by the City,
and serves no public purpose.vacation will provide a public
benefit as it will provide funds to the City and will return the
property to the tax rolls.
2.The vacation of this portion of right-of-way would not
adversely affect the street pattern or circulation of the
immediate area or the community as a whole.Ten feet of right of
way is inadequate for a public roadway.
3.The public need will not be adversely affected by the
vacation of this unopened right of way.
4.No abutting owner will become landlocked nor will
access to any abutting properties be substantially impaired.

NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1.That portion of 76th Place N.E.as legally
described in EXHIBIT A is hereby vacated.
Section 2.The above-described property shall be vacated
subject to reservation of a perpetual easement in favor of the
City of Marysville for sewer,water and drainage utilities over,
across,under and through the property described in EXHIBIT A.

Section 3.In conslderation for the vacation of said
street,the abutting owners who are receiving title to the street
shall pay the City the sum of $2,187.90 for the property
conveyed to them.Payment of said sum shall be a condition
precedent of this ordinance becoming effective.
Section 4.This ordinance and the vacation of the street
referred to herein shall become effective five (5)days after the
payment of the above-referenced sum and the publication of this
ordinance and the recording of a certified copy of the same in
the records of the Snohomish County Auditor.
PASSED by the City Council and APPROVED by the Mayor this
day of July,1996.

THE LAND REFERRED TO HEREm IS SITUATED IN THE STATE OF
WASHINGTON, COUNTY OF SNOHOMISH AND IS DESCRIBED ASFOLLOWS:
Lots 7, 8 and 9,Block 1,Aubwy's First Addition to Marysville,according to the plat
thereof recorded in Volume 2 of Plats,page 77, records of Snohomish County,
Washington.
Together with that portion of vacated alley abutting saidlots as would attach by operation
oflaw.
Situate in County ofSnohomish,State ofWashington.
