AN ORDINANCE OF THE CITY OF MARYSVILLE VACATING A PORTION OF
EIGHTH STREET.
WHEREAS,by Resolution,the Marysville City Council stated
its intention to vacate a portion of Eighth Street,and being
legally described on EXHIBIT A attached hereto;and
WHEREAS,a public hearing was held on the vacation of said
street on August 12,1996;and
WHEREAS,the City Council considered the evidence presented
at the hearing and entered the following findings of fact:
1.The above-described portion of Eighth Street has
remained unopened and/or is in excess of the right-of-way width
needed by the City since it was originally acquired by the City,
and serves no public purpose.

The vacation of this portion of right-of-way would
affect the street pattern or circulation of the
area or the community as a whole.

3.The public need will not be adversely affected by the
vacation of this alley.
4.No abutting owner will become landlocked nor will
access to any abutting properties be substantially impaired.
5.The abutting owners of the vacated street are willing
to purchase said right-of-way from the City at a total price of
$3,988.23,representing 50%of the assessed valuation of the
same.
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,
WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1.That portion of Eighth Street as legally
described in EXHIBIT A is hereby vacated.
Section 2.In consideration for the vacation of said
street,the abutting owners who are receiving title to the street
shall pay the city the sum of $3,988.23 for the property conveyed
to them.Payment of said sum shall be a condition precedent of
this ordinance becoming effective.
Section 3.This ordinance and the vacation of the street
referred to herein shall become effective five (5)days after the

payment of the above-referenced sum and the publication of this
ordinance and the recording of a certified copy of the same in
the records of the Snohomish County Auditor.

Legal Description - 8th Street Vacation
That portion of 8th Street lying southerly arid abutting lots 20, 21, and 22,Block 2,
Palmer Addition to Marysville,Washington,as per Plat recorded in Volume 2 of Plats, on
Page 40,Records of Snohomish County,Washington,lying easterly ofa line drawn
parallel with and distant 25.°feet easterly of,as measured at right angles to Burlington
Northern Railroad Company's (formerly Great Northern Railways Company)branch line
main track centerline, as now located and constructed upon,over and across said Block 2,
more particularly described as follows:
Commencing at the ~west comer of the above described tract,the true point of
beginning,
Thence southerly along the easterly margin of said railroad 11.76 feet;
Thence southeasterly 79.00 feet to a point 24.97 feet south ofthe southeast comer of said
lot 22;
Thence north 79.00 feet tot he southeast comer of said lot 22;
Thence westerly 76.62 feet to the true point of beginning.
