AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON
AUTHORIZING THE CONDEMNATION,APPROPRIATION,TAKING AND
DAMAGING OF LAND AND OTHER PROPERTYFOR THE WIDENING OF
67th AVENUE N.E. and 88th STREET N.E.
WHEREAS,the City Council of the City of Marysville
(hereinafter the "City")finds as follows:
1.Public safety,convenience,use and necessity
demand the widening of the 67th Avenue N.E.and 88th Street
N.E.rights-of-way to meet the requirements of increased
traffic.
2.The City has conducted engineering studies and has
determined that it will be necessary to acquire property for
the street widening described as follows:
(a)All that portion of the following-described Parcel "A"
described as follows:
Beginning at the Northwest corner of Parcel "A";Thence
South along the West line thereof 34.31 feet;Thence
Southeasterly to a point on the East line thereof
distant 42.14 feet South of the Northeast corner
thereof;Thence North along the East line thereof to
said Northeast corner;Thence West along the North line
thereof to the Point of Beginning.
PARCEL A:
Lot 2 of Short Plat No.68(3-81)under recording
number 8206170136,being a portion of the Southeast
quarter of the Northeast quarter of Section 22,
Township 30 North,Range 5 East,W.M.,in Snohomish
County,Washington.
(b)All that portion of the following-described Parcel "B"
described as follows:

Beginning at the Northwest corner of Parcel "B";Thence
South along the Westline thereof 30.00 feet;Thence
Southeasterly to a point 55.00 feet West of and 57.00
feet South of the Northeast corner thereof;Thence
Southeasterly to a point that is 80.00 feet South of and
25.00 feet West of the Northeast corner thereof;Thence
South parallel to the East line thereof to a point on
the south line thereof;Thence East along the South line
thereof to the Southeast corner thereof;Thence North
along the East line thereof to the Northeast corner
thereof;Thence West along the North line thereof to the
Point of Beginning.
PARCEL B:
Lot 3 of Short Plat No.68(3-81)under recording number
8206170136,being a portion of the Southeast quarter of
the Northeast quarter of Section 22,Township 30 North,
Range 5 East,W.M.,in Snohomish County,Washington.
TOGETHER WITH an easement for slopes upon the above-described
Parcel B described as follows:
Beginning at a point on the South line of said Lot 3
distant 35 feet West of the West line of a right-of-way
on Lot 3 running 40 feet to the West of and parallel to
the centerline of 67th Avenue N.E.;thence Northeasterly
to a point on said right-of-way line distant 250 feet
North of the South line of said lot;Thence South along
said right-of-way line to said South line thereof;
Thence West along said line 35 feet to the Point of
Beginning.
TOGETHER WITH that portion of said Lot 3 lying
Northeasterly of the following-described line:
Beginning at a point on the East line of said lot,
distant 40 feet South of the Northeast corner thereof;
Thence Northwesterly to a point on the North line of
said lot,distant 10 feet West of said Northeast corner
thereof and the terminus of said line.The lot lines
referred to relate to the dedicated right-of-ways of
said short plat.
3.The City has authority pursuant to RCW 8.12 to
acquire,if necessary,title to real property for public
purposes.
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF
MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS:

1.The City is hereby authorized to condemn,
appropriate,take and damage the real property located
adjacent to 67th Avenue N.E.and 88th Street N.E.as
described above.
2.The use of the property described above is to widen
67th Avenue N.E.and 88th Street N.E.,which is a permanent
public use and is reasonably necessary for the purposes for
which it is sought.
3.All lands,rights,privileges and other property
lying within the limits of the land described above are
hereby condemned,appropriated,taken and damaged for the
purpose of widening 67th Avenue N.E.and 88th Street N.E.
All lands,rights,privileges and other properties are to be
taken,damaged and appropriated only after just compensation
has been made,or paid into the court for the owners thereof
in the manner provided by law.
4.The City's attorneys should be and hereby are
authorized and directed to begin and prosecute the actions
and proceedings in a manner provided by law to carry out the
provisions of this ordinance,and to enter into settlements
to mitigate damages.
