HomeMy WebLinkAboutO-2124 - Amends Sec. 2.16.040, 2.48.020 and 2.48.030, police chief (2.16, 2.48)CITY OF MARYSVILLE Marysville, Washington ORDINANCE NO.JldY AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON EXCLUDING THE POSITION OF POLICECHIEF FROM CIVIL SERVICEAND AMENDING MMC 2.48.020,MMC 2.48.030 AND MMC 2.16.040. WHEREAS,the City of Marysville has adopted a civil Service system for the City Police Department pursuant to RCW 41.12 and Chapter 2.16 of the Marysville Municipal Code;and WHEREAS,the Marysville Police Department has six or more commissioned officers,including the Police Chief;and WHEREAS,RCW 41.12.050 authorizes the City Council to exclude from the classified civil service individuals appointed as police chief after July 1,1987 to a department with six or more commissioned officers,including the Police Chief;and WHEREAS,RCW 41.12.040(6)authorizes the City Council to refer other matters to the City Civil Service Commission;and WHEREAS,the City Council of the City of Marysville deems it to be in the best interests of the City to exclude the position of Police Chief from the classified civil service; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.Section 2.48.020 of the Marysville Municipal Code,which reads as follows: 2.48.020 Police chief.The police chief shall be the commander and administrative head of the police department.The chief shall be responsible,through the city administrator,to the mayor and city council.The position of police chief is included in the classified service and is under the jurisdiction of the civil service commission.Eligibility requirements for the position shall be established by the civil service commission and shall be consistent with the criteria specified in RCW 35.21.333.In the absence of the police chief the command of the department shall be assumed by the next highest /wpf/mv/pc.ord 1 ranking officer of the department,unless otherwise specified by written directive from the police chief. is amended to read as follows: 2.48.020 Police chief.The police chief shall be the commander and administrative head of the police department.The chief shall be responsible,through the city administrator,to the mayor and city council.In the absence of the police chief the command of the department shall be assumed by the next highest ranking officer of the department,unless otherwise specified by written directive from the police chief with the concurrence of the mayor or city administrator. Pursuant to RCW 41.12.050,all individuals hired and appointed as police chief after the effective date of this ordinance are hereby excluded from the classified civil service.Such individuals shall be employed by the city pursuant to the terms of an employment contract between the city and the police chief. Section 2.Section 2.48.030 of the Marysville Municipal Code,which reads as follows: 2.48.030 Classified personnel.All full-paid, uniformed and commissioned employees of the police department,including communications officers,custody officers,animal control officers and parking officers, but excluding clerical employees,mechanics and community service officers,shall be in the classified service,arid under the jurisdiction of the civil service commission;provided,that this shall not apply to probationary employees. is hereby amended to read as follows: 2.48.030 Classified personnel.All full-paid, uniformed and commissioned employees of the police department,including communications officers,custody officers,animal control officers and parking officers, but excluding the chief of police,clerical employees, mechanics and community service officers,shall be in the classified service,and under the jurisdiction of the civil service commission;provided,that this shall not apply to probationary employees. /wpf/mv/pc.ord 2 Section 3.Section 2.16.040 of the Marysville Municipal Code,which reads as follows: 2.16.040 Eligibility for participation in civil service system.All full-paid,uniformed and commissioned employees of the police department and fire department,including the police chief and fire chief, communications officers,custody officers,animal control officers and parking officers,but excluding clerical employees,mechanics and community service officers,shall be included in the classified civil service and shall be participants in the civil service system;provided,that such employees must first successfully qualify for permanent employment to a classified position.An employee on disability leave shall remain subject to the civil service system until such time as he or she received disability retirement and reaches the age of 50. is hereby amended to read as follows: 2.16.040 Eligibility for participation in civil service system.All full-paid,uniformed and commissioned employees of the police department,and fire department,including communications officers, custody officers,animal control officers and parking officers,but excluding the chief of police,clerical employees,mechanics and community service officers, shall be included in the classified civil service and shall be participants in the civil service system; provided,that such employees must first successfully qualify for permanent employment to a classified position.An employee on disability leave shall remain subject to the civil service system until such time as he or she received disability retirement and reaches the age of 50.
