I-~~ CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO..:7/3'1 AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON RELATING TO BUSINESSLICENSINGAND REGULATIONOF ADULT-USE BUSINESSESAND AMENDING EXISTINGREGULATIONTO PROVIDEFOR IMMEDIATE ISSUANCE OF A TEMPORARY LICENSE UPON SUBMITTAL OF A COMPLETE APPLICATION FOR ADULT CABARET MANAGERS, SECURITY PERSONNEL IN ADULT CABARETS,ADULT PANORAM MANAGERS,ASSISTANT MANAGERS IN ADULT PANORAMS,BIKINI CLUB MANAGERS AND SECURITY PERSONNEL IN BIKINI CLUBS. WHEREAS,cities have the right and duty to enact laws for the protection of the public health,safety and general welfare and morals;and WHEREAS,the City council adopted Ordinance #2070 in 1996 establishing certain business licensing requirements for adult cabarets,adult panorams and bikini clubs;and WHEREAS,the State Supreme Court in Ino Ino,Inc.v. City ox Be~levue,Docket #62941-2,filed May 1,1997, declared certain licensing requirements of the City of Bellevue to be unconstitutional;and WHEREAS,the City of Marysville wishes to amend its code to ensure full compliance with the State Supreme Court decision; NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Amendment to MMC 5.80.050(4).Marysville Municipal Code 5.80.050(4),which reads as follows: (4)An applicant for an adult entertainer's license shall be issued a temporary license upon receipt of a complete license application and fee. Said temporary license will automatically expire on the fourteenth day following the filing of the complete application and fee,unless the clerk has failed to approve or deny the license application, in which case the temporary license shall be valid until the clerk approves or denies the application, or until the final determination of any appeal from a denial of the application.In no event may the !wpf/mvjino.ord clerk extend the application review time for more than an additional 20 days.If the clerk determines that the adult entertainer has failed to qualify for the license applied for,the clerk shall deny the application in writing and shall cite the specific reasons therefor,including applicable Lawa. is hereby amended to read as follows: (4)An applicant for an adult entertainer's, manager's,assistant manager's or security personnel's license shall be issued a temporary license upon receipt of a complete license application and fee.Said temporary license will automatically expire on the fourteenth day following the filing of the complete application and fee,unless the clerk has failed to approve or deny the license application,in which case the temporary license shall be valid until the clerk approves or denies the application,or until the final determination of any appeal from a denial of the application.In no event may the clerk extend the application review time for more than an additional 20 days.If the clerk determines that the adult entertainer,manager,assistant manager or security personnel has failed to qualify for the license applied for,the clerk shall deny the application in writing and shall cite the specific reasons therefor,including applicable laws. Section 2.Amendment to MMC 5.84.040.A new subsection (5J shall be added to MMC 5.84.040,which reads as follows: (5)An applicant for a manager's or assistant manager's license shall be issued a temporary license upon receipt of a complete license application and fee.Said temporary license will automatically expire on the fourteenth (14th)day following the filing of the complete application and fee,unless the clerk has failed to approve or deny the license application,in which case the temporary license shall be valid until the clerk approves or denies the application,or until the final determination of any appeal from a denial of the application.In no event may the clerk extend the application review time for more than an additional twenty (20)days.If the clerk determines that the manager or assistant manager has failed to qualify for the license applied for, /wpf/mv/ino.ord 2 _:A the clerk shall deny the application in writing and shall cite the specific reasons therefor,including applicable laws.
