I-~:C~ CITY OF MARYSVILLE Marysville,Washington ORDINANCE NO.'J-/(pl AN ORDINANCE OF THE CITY OF MARYSVILLE,WASHINGTON CLARIFYING THE PROCESS TO OBTAIN A WAIVER OF UNDERGROUND WIRING REQUIREMENTS AND AMENDING THE PROVISIONS OF MMC 20.24.200(3)AND MMC 20.56.230(4). WHEREAS,the City wishes to clarify the City Engineer's authority regarding waiver of underground wiring requirements; NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MARYSVILLE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.MMC 20.24.200(3),which reads as follows: (3)If the appropriate utility company determines that an underground system as proposed above cannot reasonably be installed according to accepted engineering practices,this requirement may be waived upon receipt of a written notice from said utility to the City Engineer. is hereby REPEALED,and a new MMC Section 20.24.200(3)is enacted,reading as follows: (3)If the appropriate utility company will not approve an underground installation or system because it cannot reasonably be installed according to accepted engineering practices, applicant may request a waiver of the requirement of underground installation or systems to the City Engineer.If the City Engineer concurs that under accepted engineering practices underground installations or systems ca.nnot reasonably be installed,he shall grant the waiver.If the City Engineer does not concur,he shall make recommendations relating to the undergrounding of electrical service to the applicant for transmittal to the appropriate utility company. /mv/wiring.ord 1 Section 2.MMC 20.56.230(4),which reads as follows: (4)If the appropriate utility company determines that an underground system as proposed above cannot reasonably be installed according to accepted engineering practices,this requirement may be waived upon receipt of a written notice from said utility to the City Engineer. is hereby REPEALED,and a new MMC 20.56.230(4)is enacted, reading as follows: (4)If the appropriate utility company will not approve an underground installation or system because it cannot reasonably be installed according to accepted engineering practices, applicant may request a waiver of the requirement of underground installation or systems to the City Engineer.If the City Engineer concurs that under accepted engineering practices underground installations or systems cannot reasonably be installed,he shall grant the waiver.If the City Engineer does not concur,he shall make recommendations relating to the undergrounding of electrical service to the applicant for transmittal to the appropriate utility company.
