ORDINANCE NO. 2-30?
AN ORDINANCE OF THE CITY OF MARYSVILLE CONTINUING THE
MORATORIUM ON GAMBLING ACTIVITIES AS PROVIDED IN ORDINANCE
NO. 2270, AND ADOPTING FINDINGS SUPPORTING THE SAME.
WHEREAS, on July 12, 1999 the Marysville City Council
adopted Ordinance No. 2270 establishing a moratorium on the
filing and acceptance of development applications for, and
the location of, land uses operating or conducting social
card games and all gambling activities for which licenses may
be issued pursuant to Chapter 9.46 RCW, and providing for
exemptions; and
WHEREAS, pursuant to Ordinance No. 2207 the Marysville
City Council extended said moratorium through January 12,
2000; and
WHEREAS, pursuant to RCW 36.70A.390, RCW 35A.63.220 and
Ordinance No. 2270, the Marysville City Council held a public
hearing on January 3, 2000 which was continued to January 10,
2000 for the purpose of taking testimony and adopting written
findings and conclusions justifying the continuation of the
moratorium established pursuant to Ordinance No. 2270 and
continued pursuant to Ordinance No. 2287; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. The Marysville City Council hereby adopts
the following findings and conclusions justifying the
continuation of the moratorium established pursuant to
Ordinance No. 2270:
a. The state legislature and state gambling
commission have expanded the ability of gambling
licensees to conduct social card games and mini-casinos
as a commercial stimulate for the licensees' business.
b. The Marysville Municipal Code does not
presently contain regulations concerning the operation
or conduct of social card games, and more specifically,
the City does not have regulations relating to enhanced
card games or mini-casinos.

c. The City's current zoning regulations do not
address gambling establishments in a comprehensive
fashion and may allow such establishments to be located
in areas where the kind of impacts associated with
gambling, particularly gambling featuring fifteen tables
of social card games and other gambling activities, may
not be in keeping with the character of the zoning
district.
d. A committee to study potential impacts and
options available to the City to regulate gambling
establishments within the City has been or will be
formed, but such committee will require additional time
to complete its work.
e. It is also appropriate and necessary for the
City to review its current tax structure and the revenue
implications thereof as it relates to the taxation of
gambling activities within the City, and it is necessary
and appropriate for the committee to study such issues
and report to the City Council.
f. In order for the committee to review and study
the above-referenced issues relating to gambling
activities, it is necessary and appropriate to continue
the moratorium established by Ordinance No. 2270 and
continued by Ordinance No. 2287. Said moratorium shall
be continued through July 13, 2000, or until the
adoption of permanent regulations governing gambling
establishments operating social card games or gambling
activities. The moratorium may be extended as provided
in RCW 36.70A.390 and RCW 35A.63.220.
Section 2. Effective Date. The effective date of this
ordinance shall be January 13, 2000.
