HomeMy WebLinkAboutO-2312 - Street vacation; amends Ord. 2223 (Special)CITY OF MARYSVILLE Marysville, Washington ORDINANCE ~0.023/~- AN ORDINANCE OF THE CITY OF MARYSVILLE AMENDING ORDINANCE NO. 2223 RELATING TO THE VACATION OF A PORTION OF 52ND AVENUE N.E., PACIFIC STREET (UNDEVELOPED) AND TWO OTHER PORTIONS OF UNDEVELOPED RIGHT OF WAY EAST OF 52ND AVENUE N.E. WHEREAS, by Resolution No. 1906, adopted on November 2, 1998, the Marysville City Council stated its intention to vacate a portion of 52nd Avenue N.E., Pacific Street (undeveloped) and two other portions of undeveloped right of way east of 52nd Avenue N.E., and being legally described on EXHIBIT A attached hereto; and WHEREAS, on January 4, 1998, after due process as required by City Code, the City Council passed Ordinance No. 2223, vacating the described portions of 52nd Avenue N.E., Pacific Street (undeveloped) and two other portions of undeveloped right of way east of 52nd Avenue N.E.; and WHEREAS, The abutting owners of the vacated street have paid the total price of $10,339.17, representing 50% of the assessed valuation of the same; and WHEREAS, the legal description attached to Ordinance No. 2223 has been found to be incorrect. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MARYSVILLE, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The legal description of the portion of 52nd Avenue N.E., Pacific Street (undeveloped) and two other portions of undeveloped right of way east of 52nd Avenue N.E. vacated by Ordinance No. 2223 is hereby amended to read as described in EXHIBIT A attached hereto. Section 2. This ordinance and the vacation of the street referred to herein shall become effective five (5) days after the publication of this ordinance and the recording of a certified copy of the same in the records of the Snohomish County Auditor.
